Local Education Agency responsibilities. MPS is the Local Education Agency (LEA) for Contractor for purposes of all state and federal laws, codes, rules and regulations pertaining to LEA duties, rights and responsibilities, including, but not limited to the Americans with Disabilities Act (ADA), 42 U.S.C. §12101, Section 504 of the Rehabilitation Act of 1973, (Section 504), 29 U.S.C. §794, the Individuals with Disabilities Education Act (IDEA), 20 U.S.C. §1400 et seq., P.L. 114-95, Every Student Succeeds Act of 2015 (ESSA) and the Asbestos Hazard Emergency Response Act (AHERA), 15 U.S.C. §2641 et seq. Contractor staff shall participate in staff development opportunities provided by the Board pertaining to IDEA, ADA, Section 504, and AHERA. Contractor shall fully cooperate with the Board in every way deemed appropriate by the Board to allow the Board to oversee and monitor the activities of Contractor and to ensure compliance with all state and federal laws, codes, rules and regulations pertaining to LEA duties, rights and responsibilities. The Board is authorized to direct and mandate that Contractor perform such activities and take such corrective actions, as the Board may determine are necessary and/or appropriate, to ensure full compliance with all state and federal laws, codes, rules and regulations pertaining to LEA duties, rights and responsibilities.
