Loss Otherwise Compensated. The Indemnifying Party shall not be liable for any Claim to the extent that: 9.1 the matter giving rise to such Claim has been made good or is otherwise compensated for without loss to the Indemnified Party; or 9.2 the Claim is recovered by the Indemnified Party under any insurance policy.
