Common use of Lost or Damaged Personal Property Clause in Contracts

Lost or Damaged Personal Property. In the event any item of personal is lost or damaged during the course of an employee's duties while the employee is exercising due care and caution under the circumstances, the VILLAGE will reimburse the employee for the repair or replacement of such items(s). Reimbursement shall be limited to a maximum amount of $200; provided the incident and the amount of the loss or damage is reported to the Chief of Police, who shall, in the exercise of reasonable judgment, determine whether or not the loss or damage occurred in the course of the employee's duties while the employee was exercising reasonable care and caution under the circumstances. In the event that the loss or damage is determined not to be in the course of employment or due to the employee's negligence or as a result of ordinary wear, no reimbursement shall be made. Reimbursement in excess of this amount may be approved by the Village Manager, which approval shall not unreasonably be denied.
