Common use of Lunch Break Clause in Contracts

Lunch Break. All employees covered by the Agreement who work four (4) hours a day or more shall be provided an uninterrupted daily unpaid thirty (30) minute or one (1) hour lunch break to be scheduled at approximately the halfway point of their work schedule. Unless the employee is relieved of all duty during the specified lunch break, such break shall be considered an “on duty” meal period and counted as time worked. An “on duty” meal period shall be permitted only when the nature of the work prevents an employee from being relieved of all duty.

Lunch Break. All employees covered by the Agreement who work four Employees working six (46) hours a day or more shall be provided an uninterrupted daily unpaid have a duty-free lunch break of at least thirty (30) minute minutes. An “on duty” meal period shall be permitted only when the nature concurrence of the work prevents Supervisor, the unpaid lunch beak may be extended for a period of no longer than one (1) hour as determined by the District. Once an employee from being relieved of all dutyhas selected a lunch break period as described above, he/she shall continue with this lunch break period for the fiscal year.

Where possible the normal meal break should be as near as practicable to the middle of the period of duty and be of an unpaid duration of thirty (30) minutes. The Employee will also be entitled to a ten (10) minute tea break during working hours for each four (4) hours a day or more shall be provided an uninterrupted daily unpaid thirty (30) minute or one (1) hour lunch break to be scheduled at approximately the halfway point of their work schedule. Unless the employee is relieved of all duty during the specified lunch break, such break shall be considered an “on duty” meal period and counted as time worked. An “on duty” meal period shall be permitted only when the nature of the work prevents an employee from being relieved of all duty.
