Maha-Metro after giving due notice to the Licensee to Cure the Default, shall be entitled to terminate the License Agreement. For the avoidance of Doubt, it is clarified that the Cure Period available to the Licensee shall be as provided in various Clauses and sub-clauses of this Agreement.

Maha-Metro may provide electricity at the point nearest to the required location on payment of required charges as specified in Annexure - 3 : Rules and Guidelines for Release of Electric Power. The Licensee may also undertake electrical works for extension of power from nominated source under Maha-Metro supervision and complying all codal provisions & Maha-Metro specifications. The Licensee shall follow the provisions stipulated in “Annexure - 3 : Rules and Guidelines for Release of Electric Power” and as amended from time to time.
Maha-Metro has installed the displays at the aforesaid mentioned metro stations. The operation and maintenance of the same shall be done by Maha-Metro. The Successful Bidder shall only have to provide the advertisement media to Maha-Metro for display.)
Maha-Metro has designed the façade and elevation for the Project. The existing façade has been designed keeping in consideration the vision of Maha-Metro, landscape of Nagpur and essential design principles. The Concessionaire shall have the flexibility to propose a design as long as they adhere to the basic design principles considered by Maha-Metro. The design is available in Annexure- 4 for the reference of the Concessionaire. In the event, the Successful Bidder desires any change in the façade and elevation design, it should take prior approval from Maha-Metro for such change in façade and elevation design. Maha-Metro reserves the right to approve and disapprove such request. It shall be mandatory for the Successful Bidder to provide the side margins as per the DCR of Nagpur city, Final XXX policy and any other applicable norms within the project site. Permissible Built-up Area Presently, the permissible FSI on the project site is 2.5. As per Clause 13.3 of the DCR of Nagpur City, the successful bidder shall have to leave 15% open space from the total plot area of 19889.90 Sqm.The permissible FSI allowed to the successful bidder shall be on the net plot area, i.e. after deducting the open space from the total plot area. The Successful Bidder can avail maximum of FSI 4 (maximum allowable FSI) on the project site, subject to payment of additional premium as per the Transit Oriented Development Policy issued by GoM. It is to be noted that the developer shall have to pay additional premium to Maha-Metro for availing the benefit of the additional FSI. The Transit Oriented Development Policy of GoM is attached at Annex-II of the Draft Concession Agreement, for ready reference. The Lease Period of such additional built-up area, if any, shall be co-terminus with the Concession Agreement. All cost associated with the additional built-up area shall be borne by Successful Bidder.
