Tenure of License. 3.1.1. At the time of termination/natural completion of license, Maha-Metro reserves the right to ask the Licensee to restore the said tendered/ advertisement space(s) as per original allotment. 3.1.2. The License tenure shall be inclusive of fitment period of 60 days. 3.1.3. The co-branding rights of the said station shall be made available for a period of 05 (five) Years unless otherwise terminated by Maha-Metro or surrendered by the successful bidder, in term of provisions of License Agreement. 3.1.4. The tenure of License Agreement shall commence from the date of providing permission to erect the branding name of company along with station name (i.e. from the date handover of xxxxx xxxxxxx for co-branding purpose) or start of commercial service date of the selected station, whichever is later. 3.1.5. The Licensee shall not be eligible to claim any compensation on account of any delay in handing over of respective advertisement spaces to him. 3.1.6. There shall be a lock in period of two (2) years from the date of commencement of License Agreement or the date of handing over of station premises for branding, whichever is later. 3.1.7. The Successful bidder shall have option to exit from the License Agreement after completion of lock in period of 2 (two) years. For it, the Successful bidder shall have to issue 180 days prior notice to Maha-Metro. Such prior notice intimation can be given after one and half (1 ½) years however option to exit will be available only after two (2) years. The exit clause shall be as per provisions of Draft License Agreement annexed as Volume - II. 3.1.8. The tenure of any additional advertisement area handed over subsequently shall be co- terminus with above period irrespective of date of actual handing over for such additional space.
Tenure of License a. Exclusive Train Wrapping Rights for the said advertisement spaces for trains on Reach-1 (Orange line) and/or Reach-3 (Aqua Line) shall be for 3 (three) years from the date of handing over of Trains for advertisement on Reach-1 and/or Reach-3 to the Licensee. b. The Tenure of the agreement of the line/trains handed over subsequently for said agreement shall be co-terminus with the tenure of the trains handed over in the first lot. The date of handing over of first set of trains on Reach-1 and/or Reach-3, respectively shall be considered as commencement date of License period for that Reach. There is no provision for any further extension of tenure of the License Agreement/ Contract. There shall be a fitment period of 07 days from the date of first handing over of the first lot of trains for advertisement. c. There shall be a lock in period of one year from the date of commencement of license period. d. If the Licensee is desirous of surrendering the license hereby created before expiry of the lock- in period of one year, the License Agreement shall deemed to be surrendered on the date mentioned in surrender notice, subject to confirmation by Maha-Metro. In such a case, the balance Interest Free Security Deposit shall be forfeited in favour of Maha-Metro after adjustment of outstanding dues, if any, payable to Maha-Metro. No grace period shall be provided to licensee in such a case. e. The Licensee shall have option to surrender from the License Agreement immediately after completion of lock-in period of one year. For this, the licensee shall give 90 days prior notice/intimation to Maha-Metro before completion of defined lock-in period. e.g. (In case lock- in period is of one-year, prior intimation can be given after 09 months however, option to exit will be available only on completion of one year. In such a case, balance Interest Free Security Deposit of the Licensee shall be refunded after adjusting the outstanding dues, if any, payable on the part of Licensee. f. If the Licensee is desirous of surrendering the license after expiry of lock-in period but without serving any prior intimation period or shorter intimation period than 90 days, the agreement shall deemed to be surrendered on completion of such improper /short intimation period. In such cases, the Interest Free Security Deposit shall be refunded to the Licensee after adjustment of license fee for period shorter than 90 days (notice period) and outstanding dues, if any. g. Tenure of License. 5.1 Tenure of License Agreement: Exclusive Semi-Naming Rights shall be for a period of Ten(10) years with a lock in period of 2 years after the expiry of fitment period of 120 days from the date of handing over of station(s) subsequent to issue of Letter of Acceptance (LOA). The Licensee shall not be eligible to claim any compensation on account of any delay in handing over of respective advertisement spaces to him. 3.1.8. At the time of termination/natural completion of license, Maha-Metro reserves the right to ask the Licensee to restore the said tendered/ advertisement panels/ hoardings as per original allotment.

Tenure of License. Tenure of License Agreement shall be 7 (Seven) years from the date of Commencement of License Fees, unless otherwise terminated by CMRL or surrendered by the Licensee. Based on the first seven years performance, extension may be granted for a further period of 3 (three) years but only on mutually agreed terms and conditions. CMRL reserves the sole right not to give any further extension. The licensee hereby, unequivocally and voluntarily agrees not to seek any claim, damages, compensation or any other consideration due to non-extension of license by the CMRL.
Tenure of License. 6.2.1 The access to the Licensed Space(s) shall be granted to the Successful Applicant immediately from the date of handing over of the site and on execution of the License Agreement, after the payment of full Security Deposit by the successful Applicant to the KMRL. The license fee will be calculated from the expiry of 60 days (fitment period) after handing over of site or from the start of commencement of commercial operations, whichever is earlier. Completion certificate to be obtained from KMRL before start of business operation by the Licensee. In the event the licensee fails to erect the structure /starts business within the fitment period, the licensee shall be liable to pay the license fee from the expiry of 60 days from handing over of site. 6.2.2 The license granted under the license Agreement shall be valid for a period of 10 years (Ten years) from the date of license agreement. The Successful Applicant shall be obliged to pay the License Fee and all other payments, as per the terms of the Document and comply with all the terms and conditions of the License Agreement during the period of license. 6.2.3 There shall be a lock in period equivalent to 50% of license period (here 60 months) from the date of commencement of license period. 6.2.4 If the Licensee is desirous of terminating the license hereby created before expiry of the lock-in period, the License shall be deemed to terminate on the date mentioned in termination/ surrender notice, subject to confirmation by KMRL. In such a case, the Interest Free Security Deposit shall be forfeited by KMRL. No grace period shall be provided to the licensee in such a case. KMRL shall also recover the balance outstanding dues, if any through other legal means. Balance outstanding dues, shall be fully cleared before the licensee is permitted to remove their structures or else KMRL will proceed to recover the amount, as per provisions of Public Premises (Eviction of Unauthorised Occupants) Act, 1971 or any such other law in force. Licensee shall have no claim for compensation or consideration / damages. 6.2.5 Licensee shall have option to exit from the License Agreement immediately after completion of lock-in period. For this, the licensee shall give 180 days prior intimation to KMRL before completion of lock-in period. (Eg. In case lock-in period is of 2.5 years, prior intimation can be given after 2 years).
