Maintenance and Notice. Grantee shall, at its sole cost and expense and at all times, keep and maintain the Pipeline in good condition and repair and keep and maintain the Easement and the Easement Area free from storage of debris, inclusive of but not limited to, excess piping, scrap metal materials, valves, meters, pumps, fittings, connections, or other materials and supplies that are not currently in use for and necessary for the operation, maintenance, repair, etc., of the Pipeline for which the grant has been provided herein. After any such repair and/or maintenance, Grantee shall, to the extent practicable, restore the Burdened Property to its condition at the commencement of this Agreement, reasonable wear and tear and loss or casualty beyond Grantee’s control excepted. If an entry on the Burdened Property by Grantee is likely to temporarily interfere with Owner’s use of the Burdened Property, or otherwise have a disruptive effect on Owner, Grantee agrees, prior to entering into the Burdened Property, to notify Owner in advance of such contemplated entry, and shall reasonably describe the nature, extent, and length of such entry; provided, however, Grantee may enter the Burdened Property without notice in the event of emergency.

Maintenance and Notice. Licensee shall be responsible for the maintenance of its Wireless Facilities at its sole cost and expense. When maintenance requires work in the Supply Space, Licensee shall comply with the provisions of Article 7. When maintenance does not require work in the Supply Space, no advance notice to Utility is required.

If Forest Service cannot perform its full commensu- rate share of road maintenance, Forest Service shall make a cash payment to Purchaser for performance of such work. Unless agreed in writing, prehaul maintenance shall be completed on any portion of road prior to hauling on that portion. Maintenance, as used in this contract, does not include road reconstruction or repairs of an extraordi- nary nature.
