Common use of Maintenance Price Clause in Contracts

Maintenance Price. During the term of this CMC, in full consideration for the performance by DB Contractor of its duties and obligations under the CMC Documents, TxDOT shall pay the Maintenance Price set forth in Exhibit 3 in accordance with the terms and conditions as set forth in Section 8 of the CMA General Conditions, subject to adjustment by Change Order in accordance with the CMC.

Maintenance Price. During the term of this CMC, in full consideration for the performance by DB Contractor of its duties and obligations under the CMC Documents, TxDOT shall pay the Maintenance Price set forth in Exhibit 3 4, subject to adjustment by Change Order in accordance with the Capital Maintenance Contract. Payments shall be made in accordance with the terms and conditions as set forth in Section 8 of the CMA General Conditions, subject to adjustment by Change Order in accordance with the CMC.
