Common use of Maintenance Services Performed Without Direction Clause in Contracts

Maintenance Services Performed Without Direction. To the extent that Maintenance Contractor undertakes any efforts outside of the scope of the Maintenance Services, unless Maintenance Contractor has received a Directive Letter or Change Order signed by TxDOT to undertake such efforts, Maintenance Contractor shall be deemed to have undertaken the extra work voluntarily and shall not be entitled to a Change Order in connection therewith. In addition, TxDOT may require Maintenance Contractor to remove or otherwise undo any such work, at Maintenance Contractor’s sole cost.
