Major Change. For a major change referred to in paragraph (1)(a):
Major Change. For a major change referred to in clause 12.1(a):
(a) the Employer must notify the relevant Employees of the decision to introduce major change; and
(b) clauses 12.3 to 12.9 apply.
Major Change. For a major change referred to in paragraph 9.2(a):
(a) the employer must notify the relevant employees of the decision to introduce the major change; and
(b) sub-clauses 9.4 to 9.10 apply.
Major Change. For major change referred to in clause 30.1(a):
Major Change. The Employer must notify the relevant Employees of the decision to introduce the major change.
Major Change. 38.2.1 For a major change referred to in clause 38.1(a):
(a) the Employer must notify the relevant Employees of the decision to introduce the major change; and
(b) clauses 38.2.2 to 38.2.8 apply.
38.2.2 The relevant Employees may appoint a representative for the purposes of the procedures in this term.
38.2.3 If:
(a) a relevant Employee appoints, or relevant Employees appoint, a representative for the purposes of consultation; and
(b) the Employee or Employees advise the Employer of the identity of the representative; the Employer must recognise the representative.
38.2.4 As soon as practicable after making its decision, the Employer must:
(a) discuss with the relevant Employees:
i. the introduction of the change; and
ii. the effect the change is likely to have on the Employees; and
iii. measures the Employer is taking to avert or mitigate the adverse effect of the change on the Employees; and
(b) for the purposes of the discussion provide, in writing, to the relevant Employees:
i. all relevant information about the change including the nature of the change proposed; and
ii. information about the expected effects of the change on the Employees; and
iii. any other matters likely to affect the Employees.
38.2.5 However, the Employer is not required to disclose confidential or commercially sensitive information to the relevant Employees.
38.2.6 The Employer must give prompt and genuine consideration to matters raised about the major change by the relevant Employees.
38.2.7 If a term in this agreement provides for a major change to production, program, organisation, structure or technology in relation to the enterprise of the Employer, the requirements set out in Clause 38.2.1(a) and clauses 38.2.2 and 38.2.4 are taken not to apply.
38.2.8 In this term, a major change is likely to have a significant effect on Employees if it results in:
(a) the termination of the employment of Employees; or
(b) major change to the composition, operation or size of the Employer's workforce or to the skills required of Employees; or
(c) the elimination or diminution of job opportunities (including opportunities for promotion or tenure); or
i. the alteration of hours of work; or
ii. the need to retrain Employees; or
iii. the need to relocate Employees to another workplace; or iv. the restructuring of jobs.
Major Change. Where an employer has made an in-principle decision to introduce major changes in production, program, organisation, structure and/or to introduce new technology that is likely to have significant effects on employees, the employer will notify the employees who may be affected by the proposed changes and will undertake consultation as provided in this clause.
Major Change. (a) For a major change referred to in paragraph 1.13.1(a):
(i) Mater must notify the relevant Employees of the decision to introduce the major change; and
(ii) subclauses (b) to (h) apply.
(b) The relevant Employees may appoint a representative for the purposes of the procedures in this clause.
(c) If:
(i) a relevant Employee appoints, or relevant Employees appoint, a representative for the purposes of consultation; and
(ii) the Employee or Employees advise Mater of the identity of the representative; Mater must recognise the representative.
(d) As soon as practicable after making its decision, Mater must:
(i) discuss with the relevant Employees:
a. the introduction of the change; and
b. the effect the change is likely to have on the Employees; and
c. measures Mater is taking to avert or mitigate the adverse effect of the change on the Employees; and
(ii) for the purposes of the discussion — provide, in writing, to the relevant Employees:
a. all relevant information about the change including the nature of the change proposed; and
b. information about the expected effects of the change on the Employees; and
c. any other matters likely to affect the Employees.
(e) However, Mater is not required to disclose confidential or commercially sensitive information to the relevant Employees.
(f) Mater must give prompt and genuine consideration to matters raised about the major change by the relevant Employees.
(g) If a clause in this Agreement provides for a major change to production, program, organisation, structure or technology in relation to the enterprise of Mater, the requirements set out in sub clauses 1.13.2 (a)(i), (b) and (d) are taken not to apply.
(h) In this clause, a major change is likely to have a significant effect on Employees if it results in:
(i) the termination of the employment of Employees; or
(ii) major change to the composition, operation or size of Mater's workforce or to the skills required of Employees; or
(iii) the elimination or diminution of job opportunities (including opportunities for promotion or tenure); or
(iv) the alteration of hours of work; or
(v) the need to retrain Employees; or
(vi) the need to relocate Employees to another workplace; or
(vii) the restructuring of jobs.
Major Change. 9.1 A major change is likely to have a significant effect on Employees if it results in the termination of the employment of Employees, major change to the composition, operation or size of the Employer’s workforce or to the skills required of Employees, the elimination or diminution of job opportunities (including opportunities for promotion or tenure), the alteration of hours of work, the need to retrain Employees, the need to relocate Employees to another workplace or the restructuring of jobs.
9.2 Where the Employer has made a definite decision to introduce major change to production, program, organisation, structure or technology in relation to its enterprise that is likely to have a significant effect on the Employees, the Employer must consult in accordance with this clause (except where this Agreement provides for a major change to production, program, organisation, structure or technology in relation to the enterprise of the Employer).
Major Change. The Department will apprise the Uniform and Equipment Advisory Committee of the Lodge whenever major changes to the Uniform and Personal Equipment Program are anticipated.
