Mandatory Mediation Costs. The expenses of witnesses for either side shall be paid by the Party producing such witnesses. All other expenses of the mediation, including required traveling and other expenses of the mediator [Mediator], and the cost of any proofs or expert advice produced at the direct request of the Mediator, shall be borne equally by the Parties, unless they agree otherwise.

Mandatory Mediation Costs. The expenses of witnesses for either side shall be paid by the Party producing such witnesses. All other expenses of the mediation, including required traveling and expenses of the mediator, and the cost of any proofs or expert advice produced at the direct request of the mediator, shall be borne equally by the Parties, unless they agree in writing otherwise in advance. The shared costs would be minimal and are estimated at One Thousand Five Hundred Dollars ($1,500) or less for claims up to Sixty Thousand Dollars ($60,000) and Three Thousand Dollars ($3,000) or less for claims over Sixty Thousand Dollars ($60,000). If both Parties agree, then the mediation costs may increase as required for the resolution of the dispute.
