Common use of Maternity Leave/Child Care Clause in Contracts

Maternity Leave/Child Care. The Company shall grant maternity leave of absence for a period of seventeen (17) weeks without pay. Upon application, the Company shall grant up to an additional thirty-five (35) weeks child care leave without pay. During the maternity and child care leave, seniority credits and fringe benefits contained in Article 11.3 continue to apply and the Company shall pay its share of the cost of such benefits. Vacation credits and payments for holidays shall not apply while on maternity leave. This Article shall also apply for the legal adoption of a child, except the legal adoption of a spouse’s child. It is recognized that with respect to maternity leave, Article 11.2 fulfils the Company’s obligations under Section 206 of the Canada Labour Code.
