Common use of Measurement Standards Clause in Contracts

Measurement Standards. Section 2.12 of the Governance Agreement sets forth certain provisions regarding the adoption of Measurement Standards by the Board of Directors for each fiscal year. In addition, such Section 2.12 sets forth certain provisions regarding approval rights and procedures to be followed in the event that Measurement Standards shall not have been approved by the Board of Directors in a timely manner or in the event that the Measurement Standards shall not have been met at any time by the Corporation. Said provisions are incorporated herein and made a part of these Bylaws. ARTICLE IV
