Medical Evaluation Criteria. ‌ The need of a medical evaluation may arise in one of the following ways: A. An employee may voluntarily inform a school administrator that he/she has a chronic communicable disease. B. An employee may develop such observable symptoms or conditions which would cause the appropriate administrator to request a private conference with the employee to review concerns. During this conference, the employee may acknowledge contraction of a chronic communicable disease. C. If it is not ascertained at the previous private conference that the employee has contracted a chronic communicable disease, and the administrator observes continuing further and obvious deterioration of symptoms and conditions which begin to negatively affect the performance of the employee; the administrator shall request a second conference with the employee to further review any concerns. Based on the results of this second conference, the administrator shall either take no further action at that time or shall refer the matter to the Superintendent. The administrator shall keep the Superintendent informed of the results of each situation as outlined in paragraph A, B or C above. If so, then the Medical Review BOARD shall determine: 1. Whether or not the employee's current medical condition imposes a health risk to others in the school environment and the rationale for the finding. In making that determination, the Medical Review BOARD shall consider: a. the nature of the risk of the employee's medical condition; b. the duration of the medical condition; c. the severity of the risk of the medical condition; d. the probability the disease will be transmitted; and e. other relevant factors. 2. The Medical Review BOARD shall make a recommendation to the Superintendent that the employee should be: a. admitted to work unconditionally; b. admitted to work under restrictive conditions; or c. not admitted to work. The report of the Medical Review BOARD shall be in writing and shall set forth reasons for its recommendation. All costs of the Medical Review BOARD shall be borne as follows: 3. Employee's physician - any cost not borne by employee's insurance shall be paid by the BOARD. 4. BOARD's Physician - cost paid by BOARD. 5. County Health Commissioner (no costs involved). If elimination of the health risk requires the implementation of a temporary or permanent removal of an employee with a chronic communicable disease, the employer shall comply with the provisions of this AGREEMENT and ORC 3319.13.

Medical Evaluation Criteria. 1. The need of for a medical evaluation may arise in one of the following ways: A. a. An employee may voluntarily shall inform a the school administrator that he/she he has a chronic communicable diseasedisease when it is confirmed by the appropriate medical tests. B. b. An employee may develop such observable symptoms or conditions which would cause the appropriate administrator to request a private conference with the employee to review concerns. During this conference, the employee may acknowledge possible contraction of a chronic communicable disease. C. c. If it is not ascertained at the a previous private conference that the employee has contracted a chronic communicable disease, and the administrator observes continuing further and obvious deterioration of symptoms and conditions which begin to negatively affect the performance of the employee; the administrator shall request a second conference with the employee to further review any concerns. Based on the results of this second conference, the administrator shall either take no further action at that the time or shall refer the matter to the Superintendent. 2. The administrator Superintendent shall keep the Superintendent informed of the results of each situation as outlined in paragraph A, B or C above. If, as a result of consider the information received from the administrator, the Superintendent determines that administrator and determine if there is a need for a medical examination and review. When deemed necessary, the Superintendent shall will convene a the Medical Review BOARD Team comprised of the followingfollowing medical personnel: D. a. The employee's primary care physician paid by the employee's insurance with any excess paid for by the Board; b. A physician selected and paid for by the employeeBoard; E. A physician selected by the BOARD of Education; F. c. The Xxxxxx County Health Commissioner or his/her his designee, who shall chair the Team; and d. The School Nurse who serves as a liaison between the Medical Review Team and the Superintendent. 3. The Medical Review BOARD shall provide for an examination of the employee and Team may obtain, upon written voluntary authorization of the employee, all relevant and pertinent medical information from the employee's personal physicianphysician and shall provide for an examination of the employee when deemed necessary by the team. 4. The written report rendered by the Medical Review BOARD Team shall be restricted to an evaluation of the employee's medical condition and shall clearly provide whether or not the an employee has been infected with a chronic communicable disease. If so, then the Medical Review BOARD shall determineTeam shall: 1. Whether a. Determine whether or not the employee's current medical condition imposes a health risk to others in the school environment and the rationale for the findingtheir findings. In making that determination, determination the Medical Review BOARD Team shall consider: a. the 1) The nature of the risk of the employee's medical condition; b. the 2) The duration of the medical condition; c. the 3) The severity of the risk of the medical condition; d. the 4) The probability the disease will be transmitted; and e. 5) Any other relevant factors. 2. The Medical Review BOARD shall make b. Make a recommendation to the Superintendent that the employee should be: a. admitted 1) Admitted to work unconditionally; b. admitted 2) Admitted to work under restrictive conditionswith restrictions; or c. not 3) Not admitted to work. The report of the Medical Review BOARD shall be in writing and shall set forth reasons for its recommendation. All costs of the Medical Review BOARD shall be borne as follows: 3. Employee's physician - any cost not borne by employee's insurance shall be paid by the BOARD. 4. BOARD's Physician - cost paid by BOARD. 5. County Health Commissioner (no costs involved)After considering the recommendation, the Superintendent shall assign the employee to his usual place of employment unconditionally, or to a work assignment under restrictive conditions. The Superintendent may also elect to seek to have the employee utilize sick leave or be placed on an unpaid leave of absence. 6. The Medical Review Team may meet periodically to review the circumstances of the infected person. If the review suggests a need to revise the initial recommendation, it will be done in a timely manner to the Superintendent. Such recommendation may include a reassignment of responsibility or sick leave. 7. If elimination of the health risk requires the implementation of a temporary or permanent removal of an employee with a chronic communicable disease, the employer Board shall comply with the provisions of this AGREEMENT Agreement and ORC 3319.13Board Policy. 8. An employee diagnosed to have a chronic communicable disease shall have full access to sick leave and disability leave as provided by this negotiated contract and the Ohio Revised Code.
