Member Agency Responsibility for Flow in Excess of Treatment Capacity. Each Member Agency is individually responsible for all costs and responsibility of managing Wastewater Flow in excess of its Treatment Capacity, including, but not limited to, charges imposed by the City of San Diego for the conveyance, treatment, and disposal of such Wastewater by the Metro System or pursuant to a municipal transportation agreement by and between the Member Agency and the City of San Diego.

  • PERFORMING AGENCY RESPONSIBILITY FOR SYSTEM AGENCY’S TERMINATION COSTS If the System Agency terminates the Contract for cause, the Performing Agency shall be responsible to the System Agency for all costs incurred by the System Agency and the State of Texas to replace the Performing Agency.
