Common use of Method of Selection Clause in Contracts

Method of Selection. Before the initial arbitration hearing, the City and the Association Grievance Committee shall use their best efforts to select a mutually agreeable arbitrator. If the City and the Association Grievance Committee are unable to agree on an arbitrator within ten (10) days, either party may request the Wisconsin Employment Relations Commission to prepare a list of five (5) impartial arbitrators. If neither party requests a list from the Wisconsin Employment Relations Commission within twenty (20) calendar days after the notification of intent to arbitrate, the grievance shall be considered waived. The Association Grievance Committee and the City shall then alternately strike two (2) parties each on the slate with the Association exercising the first and third strikes. The Association and the City shall exercise their strikes within ten (10) calendar days following receipt of the slate from the WERC. The remaining arbitrator on the slate after the strike shall then be notified of his/her appointment in a joint statement from the City and the Association.
