Misuse of Confidential Information in the case of Licensee, its obligation to pay the Licence Fees. For the avoidance of doubt, nothing in this Agreement limits a party’s liability to the other in relation to infringement of intellectual property rights outside the scope of the licence.
Misuse of Confidential Information. Executive agrees that for a period equal to the longer of (i) one (1) year or (ii) the period during which Executive is receiving severance payments under Section 6 hereof following the end of the Term, he shall not, directly or indirectly, (i) divert or attempt to divert from Digimarc (or any Affiliate) any business of any kind in which it is engaged; or (ii) employ or recommend for employment any person employed by Digimarc (or any Affiliate), unless Executive can prove that any action taken in contravention of this subsection was done without the use in any way of Confidential Information.
Misuse of Confidential Information. Customer acknowledges and agrees that the Services contain proprietary information and trade secrets of deepwatch and its Suppliers. Customer will not use any Confidential Information or know how that it gains through use or study of the Services to facilitate Customer’s or any third party’s development of any services or products that would compete with the Services provided by deepwatch. Subject to deepwatch’s confidentiality obligations, deepwatch reserves the right to develop and market any technology, products, and/or services or pursue business opportunities that compete with and/or are similar to those of Customer.
Misuse of Confidential Information. The Receiving Party shall promptly advise TissueLink™, in writing, of any misappropriation or misuse of the Confidential Information, by any entity, that may come to its attention.

Misuse of Confidential Information. The Agent must notify the Director General immediately upon becoming aware of a suspected or actual breach of this Clause by any of the Agent’s Employees.

If the recipient develops or uses a product or process which, in the reasonable opinion of the disclosing party might have involved the misuse of any Confidential Information, the recipient shall, at the written request of the disclosing party, supply to the disclosing party all information reasonably necessary to establish that the Confidential Information has not been used or disclosed in order to develop or use that product or process.
Misuse of Confidential Information. 7.9.1 None of the Group Companies has received any claims or complaints that remain unresolved as to any misuse, on the part of any of the Group Companies, of any confidential information belonging to any third party.
7.9.2 None of the Group Companies has received any claims or complaints that remain unresolved as to any of the Group Companies having in its possession or control any confidential information belonging to any third party without license or authority of the relevant owner.
Misuse of Confidential Information. The receiving Party’s failure to fulfill the obligations and conditions with respect to any use, disclosure, publication, release, or dissemination to any third party of the disclosing Party’s Confidential Information constitutes a material breach of this Agreement. In that event the disclosing Party may, at its option and in addition to any other remedies that it may have, terminate this Agreement. In addition to any other remedies it may have, the disclosing Party has the right to demand the immediate return of all copies of Confidential Information provided to the receiving Party under this Agreement. The receiving Party recognizes that disclosure of Confidential Information in violation of this Agreement may result in irreparable harm to the disclosing Party. The disclosing Party shall have the right to seek injunctive relief in the event of a disclosure in violation of this Agreement.
Misuse of Confidential Information. Without the consent in writing of the Company’s Board of Directors (the “Board”), Employee will not, at any time during the Period of Employment and for a period of one (1) year following Employee’s Separation Date (as defined below), acting alone or in conjunction with others, use any Confidential Information to, directly or indirectly (i) induce any customers of the Company or any of its affiliates with whom Employee has had contacts or relationships, directly or indirectly, during and within the scope of his or her employment with the Operating Partnership or any of its affiliates, to curtail or cancel their business with the Company or any such affiliate; (ii) induce, or attempt to influence, any employee of the Operating Partnership or any of its affiliates to terminate employment; or (iii) solicit or assist any third party in the solicitation of, any person who is an employee of the Operating Partnership or any affiliate; provided, however, that activities engaged in by or on behalf of the Company or the Operating Partnership are not restricted by this covenant. The provisions of subsections (i), (ii), and (iii) above are separate and distinct commitments independent of each of the other subparagraphs. This Section 2 also does not limit any general advertising or job posting not directed at any individual or group of employees of the Operating Partnership or any of its affiliates. For purposes of this Agreement, “Separation Date” means the date Employee’s employment by the Operating Partnership or any of its affiliates terminates for any reason (whether with or without cause, voluntarily or involuntarily, or due to death or disability).
