MODIFICATION OF ARTICLE 2. Notwithstanding anything to the contrary in Article 2 of the Credit Agreement, from and after the date hereof, (a) no further Advances shall be made to Borrower nor shall any further Letters of Credit be issued for the benefit of Borrower or any other Loan Party and (b) Datum and Symmetricom acknowledge and agree that Bank shall be relieved of all further obligations under the Line of Credit except with respect to honoring conforming draws on the Existing Letters of Credit described on Annex 1 to this Amendment, as such Existing Letters of Credit are in effect on January 17, 2003, and in any event subject to the existing terms and conditions of all applicable Letter of Credit Agreements and related documents.
