Common use of Monitoring and Recordkeeping Clause in Contracts

Monitoring and Recordkeeping. Throughout the Affordability Period, Developer shall comply with all applicable recordkeeping and monitoring requirements of the HAL and shall annually complete and submit to Authority a Certification of Continuing Program Compliance in a form provided by Authority. Representatives of Authority (and City) shall be entitled to enter the Site upon at least forty-eight (48) hours’ notice, to monitor compliance with this Agreement, to inspect the records of the Site, and to conduct an independent audit or inspection of such records. Developer agrees to cooperate with Authority in making all of its records for Phase II and making the Site and all Housing Units thereon available for inspection or audit. Records shall be made available for review and inspection and/or audit in Orange County, California. Developer agrees to maintain all records relating to Phase II in a businesslike manner, and to maintain such records for the term of this Agreement.
