Monitoring and Supervision during Operations. a. The Concessionaire shall undertake periodic inspection of the Project in accordance with the Maintenance Manual, the Maintenance Programme, Project Requisites and this Agreement and shall submit reports of such inspection ("Maintenance Reports") to the Project Monitoring Committee and the Independent Engineer. b. The Independent Engineer shall undertake periodic (at least once every calendar quarter) inspection of the Project jointly with the Concessionaire to determine the condition of the Project including its compliance in general or otherwise with the Maintenance Manual, the Maintenance Programme, Project Requisites and this Agreement and make out a report of such inspection (the "O&M Inspection Report') and forward it to the Concessionaire with a copy thereof to the Project Monitoring Committee. The O&M Inspection Report shall set forth defects and deficiencies, if any, and may also require the Concessionaire to undertake such tests as may be specified by the Independent Engineer for the purpose of determining that the Project is at all times in conformity with the Project Requisites. The Concessionaire shall within 30 (thirty) days of the receipt of the O&M Inspection Report from the Independent Engineer remedy the defects and deficiencies and undertake such tests, if any, set forth therein, without any delay and furnish compliance thereto and/or results thereof to the Independent Engineer along with a report (O&M Inspection Compliance Report) with a copy to the Project Monitoring Committee specifying in reasonable detail the measures, if any, that have been undertaken for curing the defects or deficiencies indicated in such results. Such inspection or submission of O&M Inspection Compliance Report by the Concessionaire shall not relieve or absolve the Concessionaire of its obligations and liabilities hereunder in any manner whatsoever. Where the remedying of such defects or deficiencies and/or undertaking such tests is likely to take more than 30 (thirty) days in accordance with Good Industry Practice, the Concessionaire shall undertake the works in accordance with such practice and submit progress reports of such works every fortnight and finally the O&M Inspection Compliance Report.

The Concessionaire Operator shall within 30 (thirty) days of the receipt of the O&M Inspection Report from the Independent Engineer AUTHORITY remedy the defects and deficiencies and undertake such tests, if any, set forth therein, without any delay and furnish compliance thereto and/or results thereof to the Independent Engineer AUTHORITY along with a report (O&M Inspection Compliance Report) with a copy to the Project Monitoring Committee AUTHORITY Officials specifying in reasonable detail the measures, if any, that have been undertaken for curing the defects or deficiencies indicated in such results. Such inspection or submission of O&M Inspection Compliance Report by the Concessionaire Operator shall not relieve or absolve the Concessionaire Operator of its obligations and liabilities hereunder in any manner whatsoever. Where The O&M inspection will not be limited to the remedying of such defects or deficiencies and/or undertaking such tests is likely to take more than 30 (thirty) days in accordance with Good Industry Practice, physical infrastructure at the Concessionaire shall undertake Project but also include all the works in accordance with such practice and submit progress reports of such works every fortnight and finally services being provided by the O&M Inspection Compliance Reportoperator to the guests at the Project in terms of the availability of the services, timeliness of the services, quality of the services and any other relevant parameter.

Monitoring and Supervision during Operations. a. a) The Concessionaire shall undertake periodic inspection of the Project ISW (at least once per month) in accordance with the Maintenance Manual, the Maintenance Programme, Project Requisites Specifications and Standards and this Agreement and shall submit reports of such inspection ("Maintenance Reports") to the Project Monitoring Committee and the Independent EngineerGHMC. b. b) The Independent GHMC Engineer shall or any representative authorized by GHMC may undertake periodic (at least once every calendar quartermonth) inspection of the Project ISW jointly with the Concessionaire to determine the condition of the Project ISW including its compliance in general or otherwise with the Maintenance Manual, the Maintenance Programme, Project Requisites ; Specifications and Standards and this Agreement and make out a report of such inspection (the "O&M Inspection Report'") and forward it to the Concessionaire with a copy thereof to the Project Monitoring CommitteeConcessionaire. The O&M Inspection Report shall set forth defects and deficiencies, ; if any, and may also require the Concessionaire to undertake such tests as may be specified by the Independent Engineer for the purpose of determining that the Project is at all times in conformity with the Project Requisites. The Concessionaire shall within 30 07 (thirtyseven) days of the receipt of the O&M Inspection Report from the Independent Engineer remedy the defects and deficiencies and undertake such tests, if any, set forth therein, without any delay and furnish compliance thereto and/or results thereof to the Independent Engineer along with a report (O&M Inspection Compliance Report) with a copy to the Project Monitoring Committee specifying in reasonable detail the measures, if any, that have been undertaken for curing the defects or deficiencies indicated in such resultsdeficiencies. Such inspection or submission of O&M Inspection Compliance Report by the Concessionaire shall not relieve or or" absolve the Concessionaire of its obligations and liabilities hereunder in any manner whatsoever. The O&M Inspection Report shall set forth defects and deficiencies, if any, and may also require the Concessionaire to undertake such tests as may be specified by the Independent Engineer DUSIB for the purpose of determining that the Project is at all times in conformity with the Project RequisitesSpecifications and Standards. The Concessionaire shall within 30 (thirty) days of the receipt of the O&M Inspection Report from the Independent Engineer DUSIB remedy the defects and deficiencies and undertake such tests, if any, set forth therein, without any delay and furnish compliance thereto and/or results thereof to the Independent Engineer DUSIB along with a report (O&M Inspection Compliance Report) with a copy to the Project Monitoring Steering Committee specifying in reasonable detail the measures, if any, that have been undertaken for curing the defects or deficiencies indicated in such results. Such inspection or submission of O&M Inspection Compliance Report by the Concessionaire shall not relieve or absolve the Concessionaire of its obligations and liabilities hereunder in any manner whatsoever. Where the remedying of such defects or deficiencies and/or undertaking such tests is likely to take more than 30 (thirty) days in accordance with Good Industry Practice, the Concessionaire shall undertake the works in accordance with such practice and submit progress reports of such works every fortnight and finally the O&M Inspection Compliance Report. (c) DUSIB shall have the right to conduct any surprise/random test based on its own initiative or in response to complaint/ request from the users. In case the Tests results meets the prescribed guidelines/ standards provided in Schedule E, the cost of such test shall be borne by DUSIB otherwise the Concessionaire shall bear the cost of such Tests.

The O&M Inspection Report shall set forth defects and deficiencies, if any, and may also require the Concessionaire to undertake such tests as may be specified by the Independent Engineer NMMT Officer for the purpose of determining that the Project is at all times in conformity with the Project RequisitesSpecifications and Standards. The Concessionaire shall within 30 15 (thirtyFifteen) days of the receipt of the O&M Inspection Report from the Independent Engineer NMMT Officer remedy the defects and deficiencies and undertake such tests, if any, set forth therein, without any delay and furnish compliance thereto and/or results thereof to the Independent Engineer NMMT Officer along with a report (O&M Inspection Compliance Report) with a copy to the Project Monitoring Committee specifying in reasonable detail the measures, if any, that have been undertaken for curing the defects or deficiencies indicated in such results. Such inspection or submission of O&M Inspection Compliance Report by the Concessionaire shall not relieve or absolve the Concessionaire of its obligations and liabilities hereunder in any manner whatsoever. Where the remedying of such defects or deficiencies and/or undertaking such tests is likely to take more than 30 08 (thirtyeight) days in accordance with Good Industry Practice, the Concessionaire shall undertake the works in accordance with such practice and submit progress reports of such works every fortnight and finally the O&M Inspection Compliance Report.

The Concessionaire shall within 30 15 (thirtyFifteen) days of the receipt of the O&M Inspection Report from the Independent ITEL Engineer remedy the defects and deficiencies and undertake such tests, if any, set forth therein, without any delay and furnish compliance thereto and/or results thereof to the Independent ITEL Engineer along with a report (O&M Inspection Compliance Report) with a copy to the Project Monitoring Committee ITEL specifying in reasonable detail the measures, if any, that have been undertaken for curing the defects or deficiencies indicated in such results. Such inspection or submission of O&M Inspection Compliance Report by the Concessionaire shall not relieve or absolve the Concessionaire of its obligations and liabilities hereunder in any manner whatsoever. Where the remedying of such defects or deficiencies and/or undertaking such tests is likely to take more than 30 (thirty) days in accordance with Good Industry Practice, the Concessionaire shall undertake the works in accordance with such practice and submit progress reports of such works every fortnight and finally the O&M Inspection Compliance Report.

Such inspection or submission of O&M Inspection Compliance Report by the Concessionaire shall not relieve or absolve the Concessionaire of its obligations and liabilities hereunder in any manner whatsoever.
