Multiple Defendant Cases. Attorney agrees that, in addition to representing all persons who qualify as indigent criminal defendants in cases filed during his/her assigned month(s), he/she shall also be assigned, on a pro rata basis, to those cases in which more than one defendant qualifying for public defender services is charged in a single criminal complaint, information or indictment and cases in which the attorney otherwise responsible for defending an indigent person has a personal conflict of interest and cannot accept his/her normal appointment. The appointment rotation schedule for multiple defendant cases shall be as follows: Attorney accepting appointments during October, 2018 Attorney accepting appointments during November, 2018 Attorney accepting appointments during December, 2018 Attorney accepting appointments during January, 2019 Attorney accepting appointments during February, 2019 Attorney accepting appointments during March, 2019 Attorney accepting appointments during April, 2019 Attorney accepting appointments during May, 2019 Attorney accepting appointments during June, 2019 Attorney accepting appointments during July, 2019 Attorney accepting appointments during August, 2019 Attorney accepting appointments during September, 2019 The Public Defenders under contract with the County during Fiscal Year 2019, shall mutually agree among themselves as to the assignment of particular months of Fiscal Year 2019 among the attorneys in accordance with the number of months each such attorney is under contract with the County, and shall provide notice thereof to the Board, the District Court and Magistrate Division, and the Xxxxxx County Prosecuting Attorney. If the Public Defenders are unable to reach an agreement concerning assignment of particular months of Fiscal Year 2019, then the assignment shall be made by the District Court. County agrees that there shall be no fewer than four (4 Public Defenders under contract with the County during Fiscal Year 2019. For purposes of this paragraph 1.3, Public Defenders under contract during Fiscal Year 2019 who are in the same law firm shall collectively be considered as a single Public Defender unless the entire contract is awarded to a single firm who shall then provide the necessary attorneys to provide services under this contract.

  • PERFORMANCE OBJECTIVES 4.1 The Performance Plan (Annexure A) sets out- 4.1.1 the performance objectives and targets that must be met by the Employee; and 4.1.2 the time frames within which those performance objectives and targets must be met. 4.2 The performance objectives and targets reflected in Annexure A are set by the Employer in consultation with the Employee and based on the Integrated Development Plan, Service Delivery and Budget Implementation Plan (SDBIP) and the Budget of the Employer, and shall include key objectives; key performance indicators; target dates and weightings. 4.2.1 The key objectives describe the main tasks that need to be done. 4.2.2 The key performance indicators provide the details of the evidence that must be provided to show that a key objective has been achieved. 4.2.3 The target dates describe the timeframe in which the work must be achieved. 4.2.4 The weightings show the relative importance of the key objectives to each other. 4.3 The Employee’s performance will, in addition, be measured in terms of contributions to the goals and strategies set out in the Employer’s Integrated Development Plan.

  • Threshold Neither the Seller nor the Purchaser shall be required to make any indemnification payment pursuant to Section 8.1 or 8.2, respectively, until such time as the total amount of all Damages that have been directly or indirectly suffered or incurred by an Indemnified Party, or to which an Indemnified Party has or otherwise becomes subject to, exceeds $50,000 in the aggregate. At such time as the total amount of such Damages exceeds $50,000 in the aggregate, the Indemnified Party shall be entitled to be indemnified against the full amount of such Damages (and not merely the portion of such Damages exceeding $50,000).
