Name Branding; Product Protection. On any promotional materials used or disseminated by ABT/UK relating to the Local Business, ABT/UK shall display the ABT Brand. Where both ABT/UK's marks and the ABT Brand are displayed, the marks will be presented equally legibly, and in a size and style in accordance with ABT's then-current Global Brand Protocols.

Name Branding; Product Protection. Any promotional materials used or disseminated by Masimo Cayman and/or its Sublicensees relating to the Local Business and/or the Products shall incorporate the appropriate Masimo US Marketing Intangibles. Masimo Cayman and/or its Sublicensees shall use the Masimo US Marketing Intangibles as the sole brand for the Local Business and the Products, and not use any trademark, service xxxx, trade name, or similar identifiers other than those within the Masimo US Marketing Intangibles in connection with the Local Business and Products. Masimo Cayman and/or its Sublicensees shall fully comply with any procedures for use of the Masimo US Marketing Intangibles which may be promulgated from time to time by Masimo US in relation to Masimo Cayman’s or its Sublicensees’ use of the Masimo US Marketing Intangibles.

Licensee shall use the E-Loan Brand as the sole brand for, and not to use any trademark, service mark, xxade name or similar identifiers other than the E-Loan Brand in connection with, the Local Business. Where both Licensee's marks and the E-Loan Brand are displayed, the marks will be presented equally legibly, and in a size and style in accordance with the Global Brand Protocols.

  • Patent Applications It is understood by the parties that, pursuant to the Baylor Technology Transfer Agreement, MAS has the initial responsibility for filing, prosecution and maintenance of Patents and Patent Applications covering the Baylor Technology. The parties agree that, as between MAS and CTI, MAS shall be responsible for deciding whether and how to file, prosecute and maintain the Patents and Patent Applications, provided that:

  • Patent Markings Licensee agrees that all Licensed Products Sold by Licensee, Affiliates, and Sublicensees will be marked in accordance with each country’s patent marking laws, including Title 35, U.S. Code, in the United States.

  • Marking of Licensed Products To the extent commercially feasible and consistent with prevailing business practices, Company shall xxxx, and shall cause its Affiliates and Sublicensees to xxxx, all Licensed Products that are manufactured or sold under this Agreement with the number of each issued patent under the Patent Rights that applies to such Licensed Product.

  • Labeling Upon request, Lessee will xxxx the Equipment indicating Lessor's interest with labels provided by Lessor. Lessee will keep all Equipment free from any other marking or labeling which might be interpreted as a claim of ownership.
