Nature of Urban Renewal Project and Purpose of Agreement. The proposed Urban Renewal Project consists of designing, developing and constructing the Improvements (which includes paying the Eligible Costs of public improvements) necessary to serve the proposed Urban Renewal Area and to comply with §31-25-107(4)(g) of the Act that requires the Plan to afford maximum opportunity, consistent with the sound needs of the municipality as a whole, for the rehabilitation or redevelopment of the Urban Renewal Area by private enterprise. Approval of the Urban Renewal Plan is subject to recent legislation, including requirements imposed by HB 15-1348 for new urban renewal plans adopted after January 1, 2016.

Nature of Urban Renewal Project and Purpose of Agreement. The proposed Urban Renewal Project consists of all undertakings and activities authorized in the Urban Renewal Plan and the Act to eliminate blighted conditions and improvements including designing, developing and constructing the various public improvements and private improvements necessary to serve the Urban Renewal Plan Area, which includes improvements located within and outside the Urban Renewal Plan Area. Approval of the Urban Renewal Plan is subject to recent legislation, including requirements imposed by HB 15-1348 for new urban renewal plans adopted after January 1, 2016.
Nature of Urban Renewal Project and Purpose of Agreement. The proposed Urban Renewal Project consists of demolition and clearance of existing deteriorated buildings and structures, remediating environmental hazards, designing, developing and constructing the Improvements (which includes paying the Eligible Costs) necessary to serve the Private Use and to comply with §31-25-107(4)(g) of the Act that requires the Plan to afford maximum opportunity, consistent with the sound needs of the municipality as a whole, for the rehabilitation or redevelopment of the Urban Renewal Area by private enterprise. The Urban Renewal Plan is subject to the requirements imposed by amendments to the Act contained in HB 15-1348 on new urban renewal plans adopted after January 1, 2016. However, because of the benefits to the region and the Parties as well as the cost of eliminating blight from the Property, the Parties have agreed that it is in the public interest to enter into this Agreement and to waive certain provisions of the Act, including relevant provisions of HB 15-1348.
Nature of Urban Renewal Project and Purpose of Agreement. The proposed Urban Renewal Project includes designing, developing and constructing the Improvements (which includes paying the Eligible Costs) necessary to redevelop the Urban Renewal Area and comply with Section 31-25-107(4)(g) of the Act to afford maximum opportunity, consistent with the sound needs of the municipality as a whole, for the rehabilitation or redevelopment of the Urban Renewal Area by private enterprise. The Urban Renewal Area contains Agricultural Land that requires compliance with Sections 31-25-107(1) and (3.5) of the Act and is subject to the Amended 1348 Requirements. The Authority has submitted the proposed Plan and the Impact Report to the District as required by the Act, and, in accordance with the Act (including the Amended 1348 Requirements), the Parties desire to enter into this Agreement to facilitate adoption of the Plan.
Nature of Urban Renewal Project and Purpose of Agreement. The proposed Urban Renewal Project consists of any and all undertakings and activities authorized in the Revised Plan and the Act to eliminate blighted conditions, including demolition and clearance of existing deteriorated buildings and structures, remediating environmental hazards, designing, developing and constructing the Improvements (which includes paying the Eligible Costs) necessary to serve the Development and to comply with §31-25-107(4)(g) of the Act that requires the Revised Plan to afford maximum opportunity, consistent with the sound needs of the municipality as a whole, for the rehabilitation or redevelopment of the Urban Renewal Area by private enterprise. The Revised Plan is subject to the requirements imposed by amendments to the Act contained in HB 15-1348 (as amended by SB 16-177 and SB 17-279) on new urban renewal plans adopted after January 1, 2016.

Except as expressly set forth in the Associated Product Agreement, the terms and conditions governing the Associated Product Agreement are not affected by the termination of Your right to use the Program under this Agreement. The provisions of this Agreement that by their nature continue shall survive any expiration or termination of this Agreement.
