Common use of NETdepot Fee Increases Clause in Contracts

NETdepot Fee Increases. Unless stated to the contrary in the Agreement and subject to Sections 6.2(B) and 6.2(C), there will be no Fee increases during the Initial Term or during any Renewal Term. However, NETdepot may increase Fees following expiration of the Initial Term, any Renewal Term, or during any Auto- Renewal Term on giving at least thirty (30) days’ advance written notice. Notwithstanding the foregoing, power shall be on a one (1) year term and shall adhere to the then published rates – failure by NETdepot to adjust a power price at the renewal of the term shall not negate its ability to adjust the price at any time - one time – during the subsequent renewal term of the Customer Success Order.
