CLEC shall be liable to Embarq for any damage to the NID caused by improper or unauthorized use of Embarq’s NID by the CLEC, and in the event such damage occurs Embarq shall be entitled to seek injunctive relief to prevent NIDs further damage, in addition to any monetary damages that Embarq may be entitled to recover.
