Common use of New Appointments and Re-employment Clause in Contracts

New Appointments and Re-employment. If a bargaining unit member's appointment is terminated under this Article, the bargaining unit member’s place will not be filled by a replacement within a period of two years, unless the affected bargaining unit member has been offered reinstatement and at least fifteen days in which to accept or decline it. Offers of re-employment shall be sent to Oregon State University email addresses. For receipt of such offers, bargaining unit members terminated not for cause shall retain access to their Oregon State University email address for a period of two years (subject to the University’s Acceptable Use of Computing Resources policy). If a bargaining unit member refuses an offer of reemployment under this Section, their right to re-employment is extinguished. All bargaining unit members who are re-employed shall be offered reemployment at the same rank. All tenured bargaining unit members re-employed under the provisions of this section shall return with tenure.
