Hiring and Appointments. 15.1 The Employer will determine when a position will be filled, the type of appointment to be used when filling the position, and the skills and abilities necessary to perform the duties of the specific position within a job classification that is being filled. Only those candidates who have the position-specific skills and abilities required to perform the duties of the vacant position will be referred for further consideration by the employing Agency.
X. Xx Agency’s internal layoff list will consist of employees who have elected to place their name on the layoff list through Article 35, Layoff and Recall, of this Agreement and are confined to each individual agency.
B. The statewide layoff list will consist of employees who have elected to place their name on the statewide layoff list in accordance with WAC 000-00-000.
C. A promotional candidate is defined as an employee who has completed the probationary period within a permanent appointment and has attained permanent status within the Agency.
D. A transfer candidate is defined as an employee in permanent status in the same classification as the vacancy within the Agency.
E. A voluntary demotion candidate is defined as an employee in permanent status moving to a class in a lower salary range maximum, within the Agency.
Hiring and Appointments. The Union will be provided with a copy of the notice to the affected employee. The Union will be given an opportunity to meet with affected employees prior to implementation of the effective date of any layoff. The College or the Union may request a Union-Management Committee meeting to discuss the layoff.

Hiring and Appointments. 3.1 OAH will determine when and how a position will be filled, the types of appointment to be used when filling the position, and the qualifications necessary to perform the duties of the specific position. When making an appointment OAH commits to appointing external and internal, qualified and diverse candidates. Applicants or candidates who need a reasonable accommodation are responsible for requesting reasonable accommodations.
3.2 When OAH has a vacant, funded, Line ALJ position, OAH will fill the position as follows:
A. First, the most senior candidate on the OAH internal layoff list, established under Article 20, Layoffs and Xxxxxx, who has the competencies, skills, and abilities required for the position.
B. Second, OAH will consult the transfer or voluntary demotion request list to determine if an internal candidate who has the competencies, skills and abilities required to perform the duties of the position has expressed an interest in the position. Prior to an offer being made and/or accepted, OAH will clarify any position requirements that may result in changes to the employee’s working conditions.
C. External qualified candidates.
3.3 Promotional opportunities to fill a permanent Lead ALJ or Senior ALJ position shall be conducted through an open, competitive recruitment process. Any internal candidate who meets the qualifications as determined by OAH will be given the opportunity to interview for the promotion.
3.4 Any salaried ALJ as of July 1, 2021 who has previously approved part-time hours will not have any changes to their hours or benefits without the mutual agreement of the parties.
Hiring and Appointments. A nurse who is offered a position and refuses the offer will have his or her name removed from the list. In addition, a nurse’s name will be removed from all layoff lists upon retirement, resignation or dismissal.

Positions will be posted for at least ten (10) calendar days. Positions that are posted using the open continuous recruitment process meet the ten (10) calendar days posting requirement. When filling positions, the Employer will consider employees on the appropriate layoff list and the most senior candidate on the internal layoff list with the required skills and abilities who had indicated an appropriate geographic availability will be appointed to the position. If there are no names on the internal layoff list, the Employer will consider internal promotional candidates and employees who are requesting a transfer or voluntary demotion prior to considering other candidates. The Employer will offer an interview to at least two (2) transfer or voluntary demotion candidates with the skills and abilities required for the position.

C. An internal promotional candidate is an employee who applies for appointment with the Employer to a class with a higher salary range maximum.
D. A transfer candidate is an employee who applies for appointment with the Employer to a position in the same class, same class on a different shift or to a different class with the same salary range maximum.
E. A voluntary demotion candidate is an employee who applies for appointment with the Employer to a class with a lower salary range maximum.
F. The Employer will establish an application process for internal promotions, transfers and voluntary demotions. Consideration will be limited to employees who have the skills and abilities required for a position.
G. The Employer will establish a posting process that takes into consideration employee accessibility issues to electronic and hard copy notifications, as well as geographical issues.
Hiring and Appointments. Article 4.1 as specifically established in Article 4.1(A), (E) and (F) applies to temporary appointees.
Hiring and Appointments. If the incumbent nurse is not selected for the position, or does not have the required skills and abilities, the layoff procedure specified in Article 28, Layoff and Recall, of this Agreement will apply. If the incumbent nurse is appointed to the position, he or she must serve a trial service period.
