NEW SIGNATORIES AND PARTICIPATION. Handlers may apply to become Signatories to this Agreement at any time during the fiscal year, but will not officially become signatories until April 1st of that year or on October 1st of that year depending on the time of the year in which the handler wishes to join the Agreement. New signatories to the Agreement will not be certified or granted the right to use the official marks until they have successfully completed a compliance audit and any required corrective actions stemming from that audit. Should certification not be granted after three audits have been completed, the signatory will be considered ineligible for certification during that fiscal year. [Amended 3/5/2008 and 6/14/2011]

NEW SIGNATORIES AND PARTICIPATION. ‌ 1. Agricultural product organizations may become signatories to this Agreement during the period of time that the Department designates as the initial assent period by filing with the Department a properly executed copy of this Agreement and thereupon shall immediately become subject to the rights, duties, privileges, and immunities provided for in this Agreement. Additional agricultural product organizations may become signatories to the Agreement by filing with the Department a properly executed copy of this Agreement, at any time. 2. Signatories and participants in classifications other than those in paragraph 1 above may join the Agreement according to the terms and procedures provided in the Administrative Rules and Regulations. NEW SIGNATORIES AND PARTICIPATION. Handlers may become Signatories to this Agreement at any time prior to a new fiscal year. During the 2007-2008 fiscal year, ending on March 31, 2008, any leafy greens handler will be allowed to sign on to the Agreement at any time. Handlers signing up during 2007-2008 must abide by all terms in effect during the initial signup, including paying assessments on all leafy green product handled since April 1, 2007, and passing a certification audit before they are allowed to use the Agreement’s service mark. NEW SIGNATORIES AND PARTICIPATION. Only processors may become signatories to this Agreement. When this Agreement has been made effective by the department, and except as provided in Article XI hereof, any processor may become a party to this Agreement during the period of time that the department designates as the initial assent period by filing with the department a properly executed copy of this Agreement. Upon implementation of this Agreement, signatories shall immediately become subject to the rights, duties, privileges, and immunities provided for in this Agreement. After the close of the initial assent period, processors may become signatories to this Agreement by filing with the department an executed copy of this Agreement, not later than July 1 of any year. With board approval, this deadline may be extended for new processors that begin operation after July 1. This Agreement will apply to new signatories effective immediately upon the start of the new marketing season.

Accordingly, pursuant to the terms and conditions of this Agreement and the Registration Rights Agreement, it is hereby agreed that the execution by the Purchaser of this Agreement, in the place set forth on the Omnibus Signature Page below, shall constitute agreement to be bound by the terms and conditions hereof and the terms and conditions of the Registration Rights Agreement, with the same effect as if each of such separate but related agreement were separately signed.

  • Facsimile and Email Signatures The use of facsimile signatures and signatures delivered by email in portable document format (.pdf) affixed in the name and on behalf of the transfer agent and registrar of the Partnership on certificates representing Common Units is expressly permitted by this Agreement.

  • Counterparts; Fax Signatures This Agreement may be executed in any number of counterparts (including executed counterparts delivered and exchanged by facsimile transmission) with the same effect as if all signing parties had originally signed the same document, and all counterparts shall be construed together and shall constitute the same instrument. For all purposes, signatures delivered and exchanged by facsimile transmission shall be binding and effective to the same extent as original signatures.
