Nexus/Reasonable Relationship Challenges. Owner consents to, and waives any rights it may have now or in the future to challenge the legal validity of, the conditions, requirements, policies or programs set forth in this Agreement including, without limitation, any claim that they constitute an abuse of the police power, violate substantive due process, deny equal protection of the laws, effect a taking of property without payment of just compensation, or impose an unlawful tax.

Nexus/Reasonable Relationship Challenges. DHS SOLAR consents to, and waives any rights it may have now or in the future to challenge the legal validity of, the conditions, requirements, Subject DIF, policies or programs set forth in this Covenant including, without limitation, any claim that they constitute an abuse of police power, violate substantive due process, nexus of DIF, any claim related to DIF, deny equal protection of the laws, effect a taking of property without payment of just compensation, or impose an unlawful tax.

Nexus/Reasonable Relationship Challenges. The Developers consent to, and waive any rights they may have now or in the future to challenge the legal validity of, the conditions, requirements, policies or programs required by the Existing Land Use Regulations or this Agreement including, without limitation, any claim that they constitute an abuse of the police power, violate substantive due process, deny equal protection of the laws, effect a taking of property without payment of just compensation, or impose an unlawful tax. In the event any other party may challenge the legal validity of such conditions, requirements, policies or programs required by the Existing Land Use Regulations and/or this Agreement, Developers specifically waive any right they may have to modification of any terms of this Agreement based on the results of any such challenge by any other party.

  • Subadviser’s Relationship Notwithstanding anything herein to the contrary, Subadviser shall be an independent contractor and will have no authority to act for or represent the Trust, the Fund or Manager in any way or otherwise be deemed an agent of any of them, except to the extent expressly authorized by this Agreement or in writing by the Trust or Manager.

  • INDEPENDENT RELATIONSHIP This Agreement is not intended to constitute, create, give effect to or otherwise recognize a joint venture, partnership, or formal business organization, or agency agreement of any kind, and the rights and obligations of the Parties shall be only those expressly set forth herein.
