No Assessments. Seller has received no notice of any (a) assessments against the Property that are unpaid, whether or not they have become liens, except ad valorem taxes for the current year, or (b) any change in the assessed value or basis for levy of taxes regarding the Property.
No Assessments. To Seller’s actual knowledge, no assessments have been made against the Property that are unpaid, whether or not they have become liens.

The Borrower has not advanced funds, or induced, solicited or knowingly received any advance of funds by a party other than the related Mortgagor, directly or indirectly, for the payment of any amount required by the related Mortgage except for (A) payments in the nature of escrow payments, including without limitation, taxes and insurance payments, and (B) interest accruing from the date of the related Mortgage Note or date of disbursement of the related Mortgage proceeds, whichever is later, to the day which precedes by one month the Due Date of the first installment of principal and interest;
No Assessments. To the best of Seller's knowledge, no assessments have been made against the Property that are unpaid, whether or not they have become liens, and no impact fees or similar charges or sums are payable as result of the construction of the Improvements.
No Assessments. To the Company’s and ORA’s best knowledge, there are no pending or threatened assessments, improvements or activities of any public or quasi-public body either planned, in the process of construction or completed which may give rise to any assessment against the Property or any portion thereof, including upon completion of the Project.

There are no special or other assessments for public improvements or otherwise now affecting any of the Owned Real Property nor, to Seller’s Knowledge any of the Leased Real Property, nor to Seller’s Knowledge are there (1) any pending or threatened special assessments affecting any of the Real Property, or (2) any contemplated improvements affecting any Real Property that would result in a special assessment affecting any such Real Property. Except as set forth on Schedule 3(l)(vii), there are no tax abatements, phase-ins or tax exemptions affecting any Owned Real Property nor to Seller’s Knowledge any of the other Real Property.
No Assessments. The Facility has not been the subject of any assessments for work or improvements either completed or to be completed, and APS has no knowledge or belief that there is any pending or contemplated assessment or other specified tax or assessment relating to the Facility.
No Assessments. No assessments other than 1996 ad valorem taxes have been made against the Property that are unpaid whether or not they have become liens. If the Property or any part thereof shall be or shall have been affected by an assessment or assessments, made on or before the date of Closing, and that are or may become payable in installments, then for the purposes of this Agreement all of the unpaid installments of any such assessments, including those that are to become due and payable after the Closing, shall be deemed to be due and payable immediately and shall be paid and discharged in full by Seller at or prior to the Closing.
