No Guarantees; Disclaimer. Without altering or affecting any limitation or disclaimer set forth in the Agreement, INAP specifically and additionally disclaims any warranties or guarantees as to the effectiveness of the Management Services, that the Management Services will result in all technical issues being resolved, or that data residing on the Customer System will be unaffected or lost due to INAP’s performance of the Management Services. Customer assumes all risk of loss occasioned by any loss of data or information lost or destroyed during the course of INAP’s performance of the Management Services, except as caused directly by INAP’s gross negligence or willful misconduct in performing the Management Services COLOCATION SERVICES SCHEDULE This Colocation Services Schedule is attached and subject to the terms and conditions of the Master Services Agreement by and between INAP and Customer and governs Customer’s access to and use of the INAP Facility (as defined in the Ordering Document). All capitalized terms not defined in this Colocation Services Schedule shall have meanings given in the Standard Terms.

  • No Guarantee Each Party shall carry out the tasks assigned to it in this Project and this Agreement with care and diligence. Nevertheless, no guarantee is given that any expected Results will be achieved, or that Results are fit for any particular purpose, or that Results generated in the Project do not infringe rights of third parties, or that patent applications result in granted patents. Parties shall not create or develop any technology for the Project that knowingly infringes any third party intellectual property rights. For the avoidance of doubt, neither Parties’ obligations in this respect comprise conducting patent searches.

  • No Guarantees The District will make good faith efforts to protect children from improper or harmful matter which may be on the Internet. At the same time, in signing this agreement, the parent and Student recognize that the District makes no guarantees about preventing improper access to such materials on the part of the Student.
