No Personal Information. The Parties agree that Licensor cannot access or collect personally identifiable information through the Licensed Materials or any systems, dashboards or other derivatives developed by the Licensee.

Except for the purposes set out under this Agreement, you shall not disclose or make available to us through the Platform any personal information including those of your agents, representatives, employees, or customers etc. You shall ensure that all information disclosed and/or transferred to us has been properly anonymized or altered such that it no longer constitutes personally identifiable information or personal data under applicable laws nor subject to any obligations under applicable privacy or data protection laws. You understand and acknowledge that any data you provide to us in connection with this Agreement may be shared with our affiliates in order to perform the obligations under this Agreement and for the purpose of providing you with the access to and use of the Platform, including the Studio, and/or other related services.

Without limiting the generality of Section 3(c)(iii), Vendor acknowledges, understands and agrees that no “protected health information” (as defined by HIPAA) shall be included within the Vendor Data or otherwise uploaded provided or in any other way be made accessible to Xx.Xxxx via the Platform or the Services. For purposes of these Vendor Terms, “HIPAA” means, collectively, the Health Insurance Portability and Accountability Act of 1996, Pub. Law 104-191 (Aug. 21, 1996), its implementing regulations, and the implementing regulations of the Health Information Technology for Economic and Clinical Health Act.

No personal information, such as the Exclusive Agent’s name, the Exclusive Agent’s contact information or other personal information can be included in any property description and/or comments for an Exclusive Listing transmitted over the RLS. The Exclusive Agent’s name and contact information must appear only in the mandatory fields set forth for such information.
