No Presumption Regarding Drafter. Each of the parties hereto acknowledge and agree that the terms and provisions of this Agreement have been negotiated and discussed among the parties, and that this Agreement reflects the parties’ mutual agreement regarding the subject matter of this Agreement. Because of the nature of such negotiations and discussions, neither of the parties shall be deemed to be the drafter of the Agreement, and therefore no presumption for or against the drafter shall be applicable in interpreting or enforcing this Agreement.

Because of the nature of such negotiations and discussions, it would be inappropriate to deem either CITY or OPERATOR to be the drafter of this Agreement, and therefore no presumption for or against the drafter shall be applicable in interpreting or enforcing this Agreement.

Because of the nature of such negotiations and discussions, it would be inappropriate to deem either Owner, Club or Manager to be the drafter of Agreement, and therefore no presumption for or against the drafter shall be applicable in interpreting or enforcing Agreement.

Xxxxxx and Xxxxxx acknowledge and agree that the terms and provisions of this Lease have been negotiated and discussed between Xxxxxx and Xxxxxx, and that this Lease reflects their mutual agreement regarding the subject matter of this Lease. Because of the nature of such negotiations and discussions, it would be inappropriate to deem either Lessor or Lessee to be the drafter of this Lease, and therefore no presumption for or against the drafter shall be applicable in interpreting or enforcing this Lease. This Lease shall be interpreted in accordance with the general tenor of the language in an effort to reach an equitable result.
