NO STRIKE PLEDGE. A. It is recognized that the need for continued and uninterrupted operation of the Township’s departments and agencies is of paramount importance to the citizens of this community, and that there should be no interference with such operation. B. The Union covenants and agrees that during the terms of this Agreement that neither the Union or any person acting on its behalf will cause, authorize or support, nor will any of its members take part in (i.e., concerted failure to report for duty, or willful absence of an Employee from their position or stoppage of work or abstinence in or in part, from the full and proper performance of the Employee’s duties of employment) work stoppage, slow-down or walkout against the Township. C. The Union agrees that it will do everything in its power to prevent its members from participating in any strike, work stoppage, slow-down or other activity aforementioned, including, but not limited to publicly disavowing such action and directing all such members who participate in such activities to cease and desist from same immediately and return to work, or such other steps as may be necessary under the circumstances, and to bring about compliance with its orders. D. In the event of a strike, slow-down or walkout, it is covenanted and agreed that participation in any such activity by the Union members shall entitle the Township to take appropriate disciplinary action including, but not limited to, discharge in accordance with applicable law. E. Nothing contained in this Agreement shall be construed to limit or restrict the Township in its rights to seek and obtain such judicial relief as may be entitled to have in law or in equity for injunction or damages, or both, in the event of such a breach by the Union or its members, except that, having met the expressed requirements of this ARTICLE, the Union shall in no way be held liable for any individual or concerted action taken by members of the bargaining unit.

The PBA further agrees that its members, upon the direction of the Department Manager or his designee, will respond to cover in the Township or in any other municipality where a police emergency or rescue activity is in progress. C. SECTION 2. In the event of a strike, slowdown, walkout, “blue flu” or other form of job action, it is covenanted and agreed that participation in any such activity by any PBA member shall be deemed grounds for disciplinary action, including possible termination of employment of such Employee or Employees. SECTION 3. The Union PBA agrees that it will do everything in its power to prevent its members from participating in any strike, work stoppage, slow-down slowdown or other such activity aforementioned, including. The PBA actions will include, but not be limited to to, publicly disavowing such action activities and directing ordering all such members who participate in such activities to cease and desist from same immediately and to return to work, or along with such other steps as may be necessary under the circumstances, and circumstances to bring about compliance with its ordersorder. The Union will actively discourage and will take whatever affirmative steps are necessary to prevent or terminate any strike, work stoppage, slowdown, walkout or other job action against the Borough. D. In the event any violation of the previous paragraph occurs which is unauthorized by the Union, i.e., a “wildcat” strike or any job action identified above, the Borough agrees that there shall be no liability on the part of the international or local union, or any of its officers or agents, provided that the Union promptly orders its members to return to work. Failure of employees to return to work after being so ordered by the Union shall entitle the Township to take appropriate disciplinary action including, but not limited to, discharge in accordance with applicable lawbe cause for dismissal. E. Nothing contained in this Agreement shall be construed to limit or restrict the Township Borough in its rights right to seek and obtain such judicial relief as it may be entitled to have in law or in equity for injunction or damages, damages or both, both in the event of such a breach by the Union or its members, except that, having met the expressed requirements of this ARTICLE, the Union shall in no way be held liable for any individual or concerted action taken by members of the bargaining unitUnion.

C. The Union agrees that it will do everything in its power to prevent its members from participating in any strike, work stoppage, slow-down or other activity aforementioned, including, but not limited to publicly disavowing such action and directing all such members who participate in such activities to cease and desist from same immediately and return to work, or such other steps as may be necessary under the circumstances, and to bring about compliance with its orders. D. B. In the event of a strike, slow-down slowdown or walkout, it is covenanted and agreed that participation in any such activity by any employee covered under the Union terms of this Agreement shall be deemed grounds for discipline including possible discharge of such employee or employees. Such discipline is subject to the grievance procedure of this Agreement. C. The F.O.P. will actively discourage and will take whatever affirmative steps are necessary to prevent or terminate any strike, work stoppage, slowdown, walkout or other deliberate interference with normal work procedures against the Township. D. The Township of Neptune reserves the right when three (3) or more members shall entitle of the Police Department are unable to report to normal duty for alleged "sick leave" during times of negotiation or grievance, to order the employees to submit to examination by the Township to take appropriate disciplinary action including, but not limited to, discharge in accordance with applicable lawPhysician at Township expense. E. Nothing contained in this Agreement shall be construed to limit or restrict the Township in its rights right to seek and obtain such judicial relief as it may be entitled to have in law or in equity for injunction or damages, damages or both, both in the event of such a breach by the Union F.O.P. or its members, except that, having met the expressed requirements of this ARTICLE, the Union shall in no way be held liable for any individual or concerted action taken by members of the bargaining unit.

The Union will actively discourage any strike, slowdowns,, work stoppage, sick-out, and consistent with the rights of its members, issue a statement in writing describing such strike, slowdown, work stoppage, sick-out, as illegal and invalid. The Union further agrees that it will not defend any member who violates the aforementioned Union order to return to work. Nothing contained in the agreement shall be construed to limit or restrict the Township in its right to seek and obtain such judicial relief as it may be entitled to have in law or in equity for injunction or damages or both in the event of such breach by the Union or its members. The Union shall not be held liable for unauthorized acts of unit employees provided the Union will do everything in its power to prevent its members from participating in any strike, work stoppage, slowsick-down out, slowdowns, or other activity aforementioned, including, but not limited to publicly disavowing such action aforementioned and directing ordering all such members who participate participates in such activities activity to cease and desist from same immediately and to return to work, or work along with such other steps as may be necessary under the circumstances, and circumstances to bring about compliance with its ordersorder. D.
