In the event the Theatre wishes to submit a Recording Reproduction of an entire performance to private or public grant-making institutions institutions, to apply for prizes or awards, or fulfill festival application requirements, the Theatre may make a Recording Reproduction of the production for this sole purpose(s) and shall notify Equity SDC at the time of submission. In the event the captured material is unusable, another capture of an entire performance may be made. (9) 8. The Theatre will maintain control and ownership of all material Recorded reproduced by the Theatre and will ensure that it is used for no commercial purposes whatsoever.

Non-Broadcast. Subject to the conditions listed herein, a Recording recording may be made for non-broadcast promotion, publicity, marketing, solicitation for a separate and future Equity production, public relations, fund-raising, audience development, education, transfers to other not-for-profit Theatres, prize, award, and festival applications, and/or civic, state, and national promotion. Actors employed in a production under the terms of this Agreement may participate in the capture Recording of material for use by the Theatre Producer for the aforementioned purposes under the following terms and conditions:
(1) All capture Recording of performance and rehearsal must occur in accordance with Rule 35(C38(A). Rule 35. MEDIA: RECORDING & BROADCAST.
(2) The Theatre Producer shall receive no compensation for the exhibition of any material captured Recorded under the terms of this provision.
(3) The Theatre Producer will provide Equity with the opportunity to view the completed Recordingrecording.
(4) The edited Recording, recording under the terms of this provision, provision may constitute up to 25% of the captured Recorded material but in no case more than a total of 15 minutes of performance and/or rehearsal. The edited Recording recording may depict an entire scene or musical number.
(5) There is no time limit on the use of Additional Footage.
(6) In the event the Theatre Producer wishes to submit a Recording recording of an entire performance to private or public grant-making institutions institutions, to apply for prizes or awards, or fulfill festival application requirements, the Theatre Producer may make a Recording recording of the production for this sole purpose(s) and shall notify Equity at the time of submission. Any such Recording recording made under this Rule shall be encoded with warnings at regular five-minute intervals that state the following: THIS FOOTAGE IS FOR GRANT, PRIZE, AWARD or OR FESTIVAL APPLICATION REQUEST PURPOSES ONLY AND MAY NOT BE SCREENED FOR ANY OTHER PURPOSE. UNDER NO CIRCUMSTANCES MAY THIS FOOTAGE BE DUPLICATED. Any Recording recording made under this Rule must also include the Equity logo and identify that Actors in the production include are members of Actors' ’ Equity Association.
(7) The provisions of this section are not intended to allow Recording for the creation of television commercials and may not be used in such commercials.
(8) The Theatre Producer may retain and use Recordings recordings made under this Rule for as long as the Theatre Producer operates under the LORT Off-Broadway Agreement, after which the Recordings recordings shall be transmitted to Equity to be destroyedEquity.
(9) The Theatre Producer will maintain control and ownership of all material Recorded and will ensure that it is used for no commercial purposes whatsoever.
