Common use of Non-Contracted Services Clause in Contracts

Non-Contracted Services. The Contractor agrees, except as otherwise provided in this Agreement, that no claim for non-contracted construction services rendered or materials furnished shall be valid unless the Contractor provides the Subcontractor notice: (a) prior to furnishing of the services and materials, except in an emergency affecting the safety of persons or property; (b) in writing of such claim within three days of first furnishing such services or materials; and (c) the written charges for such services or materials no later than the fifteenth (15th) day of the calendar month following that in which the claim originated.

Non-Contracted Services. The Contractor Subcontractor agrees, except as otherwise provided in this Agreement, that no claim for non-contracted construction services rendered or materials furnished shall be valid unless the Contractor Subcontractor provides the Subcontractor Contractor notice: (a) prior to furnishing of the services and or materials, except in an emergency affecting the safety of persons or property;; and (b) in writing of such claim within three days of first furnishing such services or materials; and (c) the written charges charge for such services or materials to the contractor no later than the fifteenth day (15th) day of the calendar month following that in which the claim originated.

The Contractor agrees, except as otherwise provided in this Subcontract Agreement, that no claim for non-contracted construction services rendered or materials furnished shall be valid unless the Contractor provides the Subcontractor notice: (a) 6.5.1 prior to the furnishing of the services and materials, except in an emergency affecting the safety of persons Persons or property; (b) 6.5.2 in writing of such claim within three (3) days of first furnishing such services or materials; and (c) 6.5.3 of the written charges for such services or materials no later than the fifteenth (15th) day of the calendar month following that in which the claim originated.
