Common use of Non-Disabling Handicap Clause in Contracts

Non-Disabling Handicap. At no time while this Agreement is in force shall the Employer dis- charge, suspend, discipline or otherwise deal unjustly with or discrim- inate against, whether directly or indirectly, any employee solely by reason of such employee having incurred a non-disabling physical handicap, provided a physician mutually agreed upon certified in writ- ing that such employee is physically able to perform regular duties. Article 5-6-7
