Non-Reversionary. The Settlement Fund is non-reversionary. As of the Effective Date, all rights of Experian in or to the Settlement Fund shall be extinguished, except in the event this Settlement Agreement is terminated, as described in Paragraph 57.
Non-Reversionary. This Settlement is not a reversionary settlement. As of the Effective Date, all rights of Defendant in or to the Settlement Fund shall be extinguished, except in the event this Settlement Agreement is voided, cancelled, or terminated, as described in Section XIV of this Agreement. In the event the Effective Date occurs, no portion of the Settlement Fund shall be returned to Defendant.
Non-Reversionary. This Settlement is not a reversionary settlement. As of the Effective Date, all rights of the Defendant in or to the Settlement Fund shall be extinguished, except in the event this Settlement Agreement is voided, cancelled or terminated, as described in Section 9 of this Agreement. In the event the Effective Date occurs, no portion of the Settlement Fund shall be returned to the Defendant. Any residual funds remaining in the Net Settlement Fund, after any and all Settlement Administration Expenses, Taxes, Fee and Expense Award, Service Payments, and Settlement Payments, pursuant to the terms of this Agreement, have been paid (or set aside for such purposes), shall be distributed to the Non-Profit Residual Recipients in equal amounts.
Non-Reversionary. This is a non-reversionary settlement. As of the Effective Date, all rights of Connexin in or to the Settlement Fund shall be extinguished, except in the event this Settlement Agreement is voided, cancelled, or terminated, as set forth herein. In the event the Effective Date occurs, no portion of the Settlement Fund shall be returned to Connexin.
Non-Reversionary. This Settlement is not a reversionary settlement. As of the Effective Date, all rights of NorthStar in or to the Settlement Fund shall be extinguished, except in the event this Settlement Agreement is lawfully voided, cancelled, or terminated, as described in Section XIV of this Agreement. In the event the Effective Date occurs, no portion of the Settlement Fund shall ever be returned to NorthStar.
Non-Reversionary. The Settlement Fund is non-reversionary. As of the Effective Date, all rights of MMC in or to the Settlement Fund shall be extinguished, except in the event this Settlement Agreement is terminated, as described in Paragraph 88.
Non-Reversionary. This Settlement is not a reversionary settlement. As of 15 the Effective Date, all rights of Defendant Kroger in or to the Settlement Fund shall be extinguished, 16 except in the event this Settlement Agreement is voided, cancelled, or terminated, as described in 17 Section J in this Agreement. In the event the Effective Date occurs, no portion of the Settlement 18 Fund shall be returned to Defendant Kroger.
Non-Reversionary. This Settlement is a non-reversionary settlement. As of the Effective Date, all rights of FFCU in or to the Settlement Fund shall be extinguished, except in the event this Settlement Agreement is lawfully voided, cancelled, or terminated, as described in Section XIV of this Agreement. In the event the Effective Date occurs, no portion of the Settlement Fund shall ever be returned to FFCU.
Non-Reversionary. The Settlement Fund is non-reversionary. As of the Effective Date, all rights of Defendant in or to the Settlement Fund shall be extinguished, except in the event this Settlement Agreement is terminated, as described in Paragraphs 62-65. Any funds remaining in the Settlement Fund after the time period discussed in paragraph 11 of Addendum A and following any payments issued pursuant to Paragraph 14 of Addendum A, if any, shall be paid to St. Jude’s Children Hospital, a cy pres recipient, subject to the Court’s approval.
Non-Reversionary. The Gross Settlement Amount shall be non-reversionary. Counsel will make reasonable efforts to contact Class Members who fail to cash their settlement checks within six (6) months of receipt so that they may be issued a new check for the amount allocated under the Settlement Agreement. If after one year class members have failed to cash their checks and have not requested the issuance of a new check, such unconsummated payments and any unclaimed funds shall be donated cy-pres to Kentucky Legal Aid.
