Common use of Nondiscrimination/Affirmative Action Clause in Contracts

Nondiscrimination/Affirmative Action. A. The District shall ensure that all applicants and employees are considered only on the basis of job-related qualifications. The District shall elect employees as needed on the basis of merit, training and experience, and there shall be no illegal discrimination against any employee or applicant because of race, creed, color, sexual orientation, including gender expression or identity, national origin, marital status, religion, sex, age or the presence of sensory, mental or physical disability or the use of a trained dog guide or service animal by a person with a disability. In accordance with the Kent School District Affirmative Action Plan, the District retains the right to choose the better-qualified applicant based upon bona fide occupational qualifications. B. In implementing this Agreement the District shall recruit, employ and assign personnel in conformity with state and federal rules, laws, regulations and directives and in accordance with the Affirmative Action Plan of the Kent School District.
