Common use of Nondiscrimination & Intimidation Clause in Contracts

Nondiscrimination & Intimidation. (a) Cummins expressly agrees that in the hiring of employees for the performance of work or services under this Master Agreement or any subcontract, Cummins, its subcontractors, or any person acting on a Cummins’s or its subcontractor’s behalf shall not discriminate in the hiring of employees by reason of race, creed, sex, disability as defined in Section 4112.01 of the Ohio Revised Code nor shall it discriminate against any citizen of the State of Ohio in the employment of labor or workers who are qualified and available to perform the Work to which the employment relates. (b) Cummins expressly agrees that Cummins, any of its subcontractors, or any person on behalf of Cummins or its subcontractors in any manner shall not discriminate against or intimidate any employee hired for the performance of work or services under this Master Agreement on account of race, creed, sex, disability as defined in Section 4112.01 of the Ohio Revised Code, or color. (c) Cummins expressly agrees to include the provisions of this section in each of its written subcontractor agreements for the Products & Services subject to this Master Agreement.

(a) Cummins Capital Rx expressly agrees that in the hiring of employees for the performance of work or services under this Master Agreement or any subcontract, CumminsCapital Rx, its subcontractors, or any person acting on a CumminsCapital Rx’s or its subcontractor’s behalf shall not discriminate in the hiring of employees by reason of race, creed, sex, disability as defined in Section 4112.01 of the Ohio Revised Code nor shall it discriminate against any citizen of the State of Ohio in the employment of labor or workers who are qualified and available to perform the Work to which the employment relates. (b) Cummins Capital Rx expressly agrees that CumminsCapital Rx, any of its subcontractors, or any person on behalf of Cummins Capital Rx or its subcontractors in any manner shall not discriminate against or intimidate any employee hired for the performance of work or services under this Master Agreement on account of race, creed, sex, disability as defined in Section 4112.01 of the Ohio Revised Code, or color. (c) Cummins Capital Rx expressly agrees to include the provisions of this section in each of its written subcontractor agreements to the extent possible, for the Products & Services subject to this Master Agreement. APPENDIX A: TERM OF AGREEMENT; NOTICES‌ This Appendix may be modified at any time with the mutual written consent of the Parties.

(b) Cummins Willscot expressly agrees that CumminsWillscot, any of its subcontractors, or any person on behalf of Cummins Willscot or its subcontractors in any manner shall not discriminate against or intimidate any employee hired for the performance of work or services under this Master Agreement on account of race, creed, sex, disability as defined in Section 4112.01 of the Ohio Revised Code, or color. (c) Cummins Willscot expressly agrees to include the provisions of this section or substantially similar provisions in each of its written subcontractor agreements for the Products & Services subject to this Master Agreement.

(a) Cummins OPEX expressly agrees that in the hiring of employees for the performance of work or services under this Master Agreement or any subcontractsubcontract that takes place in the State of Ohio, CumminsOPEX, its subcontractors, or any person acting on a CumminsOPEX’s or its subcontractor’s behalf shall not discriminate in the hiring of employees by reason of race, creed, sex, disability as defined in Section 4112.01 of the Ohio Revised Code nor shall it discriminate against any citizen of the State of Ohio in the employment of labor or workers who are qualified and available to perform the Work to which the employment relates. (b) Cummins OPEX expressly agrees that CumminsOPEX, any of its subcontractors, or any person on behalf of Cummins OPEX or its subcontractors in any manner shall not discriminate against or intimidate any employee hired for the performance of work or services under this Master Agreement on account of race, creed, sex, disability as defined in Section 4112.01 of the Ohio Revised Code, or color. (c) Cummins OPEX expressly agrees to include the principally similar provisions of this section in each of its written subcontractor agreements for the Products & Services subject to this Master Agreement.

(b) Cummins PRO*ACT expressly agrees that CumminsPRO*ACT, any of its subcontractors, or any person on behalf of Cummins PRO*ACT or its subcontractors in any manner shall not discriminate against or intimidate any employee hired for the performance of work or services under this Master Agreement on account of race, creed, sex, disability as defined in Section 4112.01 of the Ohio Revised Code, or color. (c) Cummins PRO*ACT expressly agrees to include the provisions of this section in each of its written subcontractor agreements for the Products & Services subject to this Master Agreement.

(c) Cummins MMSGS expressly agrees to include the provisions of this section in each of its written subcontractor agreements for the Products & Services subject to this Master Agreement.

(c) Cummins Ameresco expressly agrees to include the principally similar provisions of this section in each of its written subcontractor agreements for the Products & Services subject to this Master Agreement.

(b) Cummins Liftnow expressly agrees that CumminsLiftnow, any of its subcontractors, or any person on behalf of Cummins Liftnow or its subcontractors in any manner shall not discriminate against or intimidate any employee hired for the performance of work or services under this Master Agreement on account of race, creed, sex, disability as defined in Section 4112.01 of the Ohio Revised Code, or color. (c) Cummins Liftnow expressly agrees to include the principally similar provisions of this section in each of its written subcontractor agreements for the Products & Services subject to this Master Agreement.

(b) Cummins Stericycle expressly agrees that CumminsStericycle, any of its subcontractors, or any person on behalf of Cummins Stericycle or its subcontractors in any manner shall not discriminate against or intimidate any employee hired for the performance of work or services under this Master Agreement on account of race, creed, sex, disability as defined in Section 4112.01 of the Ohio Revised Code, or color. (c) Cummins Stericycle expressly agrees to include the provisions of this section in each of its written subcontractor agreements for the Products & Services subject to this Master Agreement.
