Common use of Nondiscrimination Rules Clause in Contracts

Nondiscrimination Rules. If the Plan Administrator determines at any time that the Plan may not satisfy the nondiscrimination rules in the Code, the Plan Administrator may take whatever action it considers appropriate to assure compliance with the rule. Any action shall be taken uniformly with respect to similarly situated Participants. The action may include the modification of Participants’ Compensation Reduction elections, with or without the consent of the Participants.
