Nonexclusive Franchise. The Franchise is nonexclusive. Nothing in this Agreement shall affect the right of the Franchising Authority to grant to any Person, or to itself, a franchise, consent, or right to occupy and use the Streets, or any part thereof, for the construction, operation, or maintenance of all or any part of a Communications System within the Franchise Area or for any other purpose.

Nonexclusive Franchise. This Franchise Agreement shall be nonexclusive.
Nonexclusive Franchise. The grant of this Franchise shall not confer any exclusive right, privilege, license or franchise to occupy or use the Rights of Way of the City for delivery of Communications Services or any other purposes, and nothing herein contained shall be construed to prevent the City from granting other like or similar grants or privileges to any other person, firm or corporation, subject, however, to the rights granted to Grantee herein. Nothing agreed to in this Franchise is intended to deny or lessen the powers and privileges granted the City under the Constitution and laws of the State of Oregon.
Nonexclusive Franchise. The Franchise granted herein shall be nonexclusive. The County specifically reserves the right to grant, at any time, such rights, permits, licenses and/or franchises to other Persons to use the rights of way for similar or different purposes allowed hereunder as the County deems appropriate. Subject to this Franchise, Grantee shall not prevent or prohibit the County from constructing, altering, maintaining or using any of said rights of way, or affect its jurisdiction over them or any part of them, the County having full power and authority to make all necessary changes, relocation, repairs, or maintenance of said rights of way as the County deems appropriate.
Nonexclusive Franchise. This Franchise shall be nonexclusive. The City considers it to be in the public interest that residents of the City have alternatives in service and providers, and intends by granting this and other franchises and by the terms hereof to xxxxxx fair competition among providers and to inhibit anti-competitive practice by the Grantee and other providers. The City has granted a similar franchise to another Cable Service provider. The City reserves the right to grant a similar franchise to another Cable Service provider at any time during the period of this Franchise, consistent with Minnesota Statutes section 238.08, subdivision 1(b) and 47 U.S.C. § 541. Grantee acknowledges and accepts the existence of one or more competing providers of Cable Services in the City, and agrees to compete fairly and to refrain from engaging in anti- competitive practices.
Nonexclusive Franchise. The County hereby grants to the Franchisee, during the term of this Agreement, a non-exclusive Franchise which grants the Franchisee the right and privilege to construct and operate a Gas Distribution System in, along, among, upon, across, above, over, under or in any manner connected with Public Ways within the Service Area, and for that purpose to erect, install, construct, repair, replace, reconstruct, maintain, or retain in, on, over, under, upon, across, or along any Public Way and all extensions thereof and additions thereto, such distribution pipes and regulator stations, wires, cables, conductors, ducts, conduits, vaults, manholes, pedestals, amplifiers, appliances, attachments, power supplies, network reliability units and other related property or equipment as may be necessary or appurtenant to the Gas Distribution System. The Franchise granted herein shall not preclude the County from granting other or further franchises or permits or preclude the County from using any Public Way, or limit the full power of the County to make such changes, as the County shall reasonably deem necessary, including but not limited to the dedication, establishment, maintenance and improvement of all new or currently improved Public Ways.

It does not prohibit the City from granting other franchises of a like nature or franchises for other public or private utilities over, along, across, under, and upon rights- of-way, or affect its jurisdiction over them, with full power to make changes, such as but not limited to, relocations, repairs, or maintenance.

Nonexclusive Franchise. A. This section grants a thirteen-year nonexclusive Franchise to operate a cable television system to MCC Iowa LLC (hereinafter referred to as Franchisee). The Franchise granted shall, as set forth below, be subject to the provisions of the Broadband Telecommunications Enabling Ordinance and this Franchise Agreement. B. Subject to Section 626 of the Cable Television Consumer Protection and Competition Act of 1992 and the Telecommunications Act of 1996, the City Council reserves the right to refuse to select a Franchise holder if such refusal is subsequently deemed to be in the public interest. C. If the terms and conditions specified in this Franchise conflict or modify the Ordinance, the provisions of the Ordinance shall apply.
Nonexclusive Franchise. This Franchise shall be nonexclusive. The City may grant additional franchises consistent with Minnesota Statutes Section 238.08, subdivision 1(b) and 47 U.S.C. § 541.

(B) If the Leased Premises are not operated as a Champps Restaurant or other casual dining sit-down restaurant or other permitted use hereunder, or remain closed for thirty (30) consecutive days (unless such closure results from reasons beyond Lessee's reasonable control) and in the event Lessee fails to pay Rent when due or fulfill any other obligation hereunder, then Lessee shall be in default hereunder and Lessor may, at its option, cancel this Lease by giving written notice to Lessee or exercise any other right or remedy that Lessor may have; provided, however, that closings shall be reasonably permitted for replacement of trade fixtures or during periods of repair after destruction or due to remodeling.
