Northern Burial Preserve. 152. During the first hearing, Xxxxxxxx and de Xxxx testified that the OHA MOA called for a larger area to be set aside for the Northern Burial Preserve and that the Wailea Wing addition of the Project will encroach into the Northern Burial Preserve’s boundaries. I-212 (Northern Burial Preserve Overlay); Tr. 8/3/20 (Kamekona) at 821:2—822:4; Tr. 7/31/20 (DeNaie) at 722-24. During the second hearing, Intervenor witnesses continued to raise objections to the location of the preserve and impacts. See e.g., Tr. 6/18/21 (Xxxxx) at 115-116 (testifying that he is a xxxxxx xxxxx traditional and customary practitioner of lā`au lapa`au and ho`oponopono and that upon the request of Aunty Xxxxx Xxxxxxxx, he participated in the blessing of the Northern Burial Preserve at GWR and that the Northern Burial Preserve was to be a sacred area away from the business of the hotel and should not be disturbed). 153. Exhibit A-121 is the Notice of Memorandum of Agreement Relating to the Disinterment and Reburial of Native Hawaiian Xxxxxx at the Site of the Grand Hyatt Wailea, Maui pertaining to the Northern Burial Preserve, where the preserve’s boundaries were expanded from 1,423 feet² to 7,267 feet², and the area recorded with the Bureau of Conveyances on June 27, 2019 to assure preservation in perpetuity. The buffers that exist today for the Northern Burial Preserve were developed in consultation primarily with Xxxx Xxxx (“Xxxx”) and others. Tr. 7/29/20 (Xxxxx) at 182:14-21. 154. As to boundaries of the Northern Burial Preserve, Xxxxx testified: ·1 Q.· · Now, there's been some suggestion that the -- ·2· ·OHA MOU is a different area, and do you have any comment ·3· ·on that? ·4· · · ·A.· · So I've reviewed the MOA, and it was the guiding ·5· ·document for my consultation with Xxxx Xxxx.· The MOA ·6· ·actually has a number of attachments which are provided in ·7· ·our monitoring plan.· There's a general overall map that ·8· ·shows a conceptual area, and I believe this was referred ·9· ·to earlier in testimony.· And then there's some subsequent 10· ·maps that show more detail.

  • UTILITIES The Landlord shall provide the following utilities and services to the Tenant: _ _. Any other utilities or services not mentioned will be the responsibility of the Tenant.

  • Student Data Property of LEA All Student Data transmitted to the Provider pursuant to the Service Agreement is and will continue to be the property of and under the control of the LEA. The Provider further acknowledges and agrees that all copies of such Student Data transmitted to the Provider, including any modifications or additions or any portion thereof from any source, are subject to the provisions of this DPA in the same manner as the original Student Data. The Parties agree that as between them, all rights, including all intellectual property rights in and to Student Data contemplated per the Service Agreement, shall remain the exclusive property of the LEA. For the purposes of FERPA, the Provider shall be considered a School Official, under the control and direction of the LEA as it pertains to the use of Student Data, notwithstanding the above.

  • Data Storage Where required by applicable law, Student Data shall be stored within the United States. Upon request of the LEA, Provider will provide a list of the locations where Student Data is stored.

  • Scope of Services The specific scope of work for each job shall be determined in advance and in writing between TIPS Member, Member’s design professionals and Vendor. It is permitted for the TIPS Member to provide a general scope description, but the awarded vendor should provide a written scope of work, and if applicable, according to the TIPS Member’s design Professional as part of the proposal. Once the scope of the job is agreed to, the TIPS Member will issue a PO and/or an Agreement or Contract with the Job Order Contract Proposal referenced or as an attachment along with bond and any other special provisions agreed by the TIPS Member. If special terms and conditions other than those covered within this solicitation and awarded Agreements are required, they will be attached to the PO and/or an Agreement or Contract and shall take precedence over those in this base TIPS Vendor Agreement.

To qualify for this Referral Fee waiver, Recipient Broker/Agent must update the Referral Status in the XXXX.xxx Agent Portal (xxxxx://xxxxxx.xxxx.xxx) to reflect the property has been listed prior to XXXX.xxx indicating that an appointment has been set.

  • HEALTH AND SAFETY 16.01 The Employer, Union and the employees shall comply with the provisions of the Occupational Health and Safety Act where and when applicable. The Employer shall provide working conditions at all times which are not prejudicial to the health or efficiency of the workers. Employees are required to report to their Employer any unsafe work conditions, or violation of any safe work policies or procedures established by the Employer, or any violation of relevant safe work legislation.
