INTERIM PROTECTION MEASURES. 1. An Arbitral Tribunal may, at the request of a disputing party and where the circumstances of the case so require, order an interim measure of protection to preserve the rights of a disputing party, or to ensure that the jurisdiction of the Arbitral Tribunal is made fully effective, including an order to preserve evidence in the possession or control of a disputing party or to protect the jurisdiction of the Arbitral Tribunal.

INTERIM PROTECTION MEASURES. In consultation with community members, the landowner has agreed to install a wood-frame or similar barrier around SIHP # -8658 (burial preserve) prior to the start of construction. The barrier is intended to provide additional protection to the area from nearby construction at the Wailea Wing and North Parking Garage and from construction vehicle traffic. An entrance into the barrier will be included in the design and access to the burial preserve by cultural practitioners and/or descendants will be maintained.
