Not Covered Events. Losses, damages and liabilities not covered by the aforementioned insurance policies, or lack of coverage will be provided by the CONCESSIONAIRE, who will be solely liable against the GRANTOR for any loss or damage caused. In case of force majeure or fortuitous event the CONCESSIONAIRE responsibility will be for the total amount insured. The amount to be secured in each of the above policies will be determined by the CONCESSIONAIRE at a level sufficient to cover the damage according to each type of policy. The CONCESSIONAIRE shall be responsible for the balance not covered by the hired insurance, in the event that any claim on his part exceeds the sum insured, relieving of liability to the GRANTOR. The copies of the final hired policies must be delivered to the REGULATOR according to the following terms and deadlines:

  • Default Events (a) Any material breach of the Funding Agreement by the Recipient, including those set out below, will be an event of default (“Default Event”):
