Notice and documentation. (a) The employee must give the Company at least 10 weeks notice of the proposed period of leave, and the starting and finishing dates of the leave. He must also give the Company, at the same time: (i) a certificate from a registered medical practitioner stating the name of his spouse, the fact that she is pregnant and the expected date of birth or the date on which the birth took place; (ii) a statutory declaration stating that he will be the primary care giver to the child, and the details of any maternity leave to be taken or already taken by his spouse, and also stating that he will not engage in any conduct inconsistent with his contract of employment during the period of paternity leave. (b) The employee is not in breach of this Agreement if he does not give the proper notice because the birth occurs earlier than expected or the mother of the child dies or some other compelling circumstance. He must however inform the Company immediately of any change in the information given in the certificate and statutory declaration.
