Notice of Completion; Copy of Record Set of Plans. Within fifteen (15) days after completion of construction of the Tenant Improvements and Compliance Work, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the County of San Francisco in accordance with Section 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of mylar as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within ninety (90) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises constructed by Tenant.

Within fifteen ten (1510) days after completion of construction of the Tenant Improvements and Compliance WorkLessee Improvements, Tenant Lessee shall cause a Notice of Completion to be recorded in the office of the Recorder of the County of San Francisco Mateo in accordance with Section 8182 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord Lessor upon such recordation. If Tenant Lessee fails to do so, Landlord Lessor may execute and file the same on behalf of Tenant Lessee as TenantLessee’s agent for such purpose, at TenantLessee’s sole cost and expense. Concurrent with Lessor’s delivery of Building 10 to Lessee, Lessor shall deliver to Lessee a “record set” of “as-built” drawings for the building shell. At the conclusion of construction, (i) Tenant Lessee shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course prepare a “record set” of construction“as-built” drawings, (B) to certify to the best of their knowledge that the “record-set” of mylar “as-built built” drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord Lessor two (2) printed sets of copies and one (1) electronic set in CAD format on CD of such record set of drawings within ninety sixty (9060) days following issuance of a certificate final permit accepting the work of occupancy for the PremisesLessee Improvements or similar final sign-off, and (ii) Tenant Lessee shall deliver to Landlord Lessor a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises constructed by TenantPremises.

If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Construction Drawings as necessary to reflect all changes made to the Approved Working Construction Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of mylar as-built updated drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies CD-ROMs of such record set of drawings updated Approved Construction Drawings, in CADD format, within ninety thirty (9030) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises constructed by TenantPremises.

At Within thirty (30) days following the conclusion completion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of mylar as-built updated drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (C) to deliver to Landlord two (2) sets of copies CD ROMS of such record set of updated drawings within ninety (90) days following issuance of a certificate of occupancy for the Premisesin accordance with Landlord’s then current CAD format requirements, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises constructed by Tenant.Premises. SECTION 4

Notice of Completion; Copy of Record Set of Plans. Tenant hereby indemnifies Landlord for any loss, claims, damages or delays arising from the actions of Architect on the Premises or in the Building. Within fifteen ten (1510) days after completion of construction of the Tenant Improvements and Compliance WorkImprovements, Tenant shall cause a Notice of Completion to be recorded in the office of the County Recorder of the County of San Francisco county in which the Building is located in accordance with Section 8182 of the Civil Code of the State of California or any successor statute, statute and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, failing which, Landlord may itself execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s 's sole cost and expense. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s 's agent for such purpose, at Tenant’s 's sole cost and expense. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Construction Drawings as necessary to reflect all changes made to the Approved Working Construction Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of mylar as-built updated drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies CD-ROMs of such record set of drawings updated Approved Construction Drawings, in CAD format, within ninety thirty (9030) days following issuance of a certificate of occupancy for the Premises, (ii) Tenant shall deliver to Landlord a copy of all LEED-EB requirement records indicating compliance with the Specifications relating to the LEED-EB Specifications, and (iiiii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises constructed by TenantTenant Improvements.

Within fifteen ninety (1590) days after completion of construction of the Tenant Improvements and Compliance Workfor the applicable Suite or the Original Premises, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the County of San Francisco county in which the Building is located in accordance with Section 8182 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of constructionconstruction for each Suite and the Original Premises, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of mylar as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within ninety thirty (9030) days following issuance of a certificate of occupancy for the applicable Suite or the Original Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in each Suite and the Premises constructed by TenantOriginal Premises.

SFLEGAL\MY Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of mylar as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two four (24) sets of copies of such record set of drawings within ninety (90) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises constructed by Tenant.Premises. SECTION 5

If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (Ax) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (By) to certify to the best of their knowledge that the “record-set” of mylar as-built drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (Cz) to deliver to Landlord two (2) sets of copies of such record set of drawings (including one set in an AutoCAD Computer Assisted Drafting and Design System format) within ninety (90) days following issuance of a EXHIBIT B certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises constructed by TenantPremises.

Within fifteen thirty (1530) days after completion of construction of any portion of the Tenant Improvements and Compliance WorkImprovements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the County of San Francisco County in accordance with Section 8182 of the California Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation, and shall timely give all notices required pursuant to Section 8188 or 8190 of the California Civil Code or any successor statutes. If Tenant fails to do so, Landlord Xxxxxxxx may execute and file the same such Notice of Completion and give such notices on behalf of Tenant Xxxxxx as TenantXxxxxx’s agent for such purpose, at Tenant’s sole cost and expense. At Within thirty (30) days following the conclusion completion of constructionconstruction of any portion of the Tenant Improvements, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of mylar as-built updated drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of updated drawings within ninety (90) days following issuance of a certificate of occupancy for the Premisesin accordance with Landlord’s then-current CAD Format Requirements, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises constructed by Tenantas Landlord may require.

If Tenant fails to do so, Landlord may Landxxxx xxx execute and file the same on behalf of Tenant as Tenant’s agent Tenaxx xx Tenaxx’x xgent for such purpose, at Tenant’s sole Tenaxx’x xole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and EXHIBIT B -7- SEQUENCE TECHNOLOGY CENTER [Expansion and Extension Amendment] [DexCom, Inc.] Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of mylar as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within ninety (90) days following issuance of a certificate of occupancy for the Premisesdrawings, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises constructed by Tenantapplicable portion of the Premises.
