Notification of Incidents and Claims. Customer agrees to notify Xxxxx of any incident involving Xxxxx Xxxxxxxxx within forty-eight (48) hours of its occurrence. Customer agrees to provide Maxim documentation of any investigation conducted. Xxxxx and Customer agree to notify each other in writing of any asserted claim relating to this Agreement within ten (10) days of either discovery of the occurrence upon which the claim may be based or learning of the claim. Indemnity to Customer shall not cover any claims or liabilities in which there is a failure to give the indemnifying party prompt notice of any incident within forty-eight (48) hours of its occurrence.

The Library shall immediately notify the City of all incidents or circumstances that may result in a claim or give rise to a claim as well as claims that are made against the Library arising from the responsibilities as set out in this Agreement. The Library shall provide the City with complete copies of all incident reports, correspondence, and notices of claims upon request.
