Common use of Obligation to Refrain from Discrimination Clause in Contracts

Obligation to Refrain from Discrimination. Hunter Fiat covenants and agrees for itself, its successors, its assigns and every successor in interest to the Site, or any part thereof, that there shall be no discrimination against or segregation of, any person or group of persons on account of any basis listed in subdivision (a) or (d) of Section 12955 of the Government Code, as those bases are defined in Sections 12926, 12926.1, subdivision (m) and paragraph (1) of subdivision (p) of Section 12955, and Section 12955.2 of the Government Code, in the sale, lease, sublease, transfer, use, occupancy, tenure, or enjoyment of the premises herein conveyed, nor shall the grantee or any person claiming under or through him or her, establish or permit any practice or practices of discrimination or segregation with reference to the selection, location, number, use or occupancy of tenants, lessees, subtenants, sublessees, or vendees in the premises herein conveyed. The foregoing covenants shall run with the land.‌

Hunter Fiat Owner covenants and agrees for itself, its successors, successors and its assigns and every successor in interest to the SiteProperty, the Leasehold, or the Improvements or any part thereof, that there shall be no discrimination against or segregation of, of any person or group of persons persons, on account of any basis listed in subdivision (a) or (d) of Section 12955 of the Government Code, as those bases are defined in Sections 12926, 12926.1, subdivision (m) and paragraph (1) of subdivision (p) of Section 12955, and Section 12955.2 of the Government Code, in the sale, lease, sublease, transfer, use, occupancy, tenure, or enjoyment of the premises herein conveyedland, nor shall the grantee transferee itself or any person claiming under or through him or her, establish or permit any such practice or practices of discrimination or segregation with reference to the selection, location, number, use use, or occupancy occupancy, of tenants, lessees, sublessees, subtenants, sublessees, or vendees in of the premises herein conveyed. Hunter Fiat The Developer covenants and agrees for itself, its successors, its assigns and every successor in successor-in-interest to all or any portion of the Site, or any part thereof, that there shall be no discrimination against or segregation ofof any person, any person or group of persons persons, on account of any basis listed in subdivision (a) or (d) of Section 12955 of the Government Code, as those bases are defined in Sections 12926, 12926.1, subdivision (m) and paragraph (1) of subdivision (p) of Section 12955, and Section 12955.2 of the Government Code, Code in the sale, lease, sublease, transfer, use, occupancy, tenure, tenure or enjoyment of the premises herein conveyed, Site nor shall the grantee Developer, itself or any person claiming under or through him or herit, establish or permit any such practice or practices of discrimination or segregation with reference to the selection, location, number, use or occupancy of purchasers, tenants, lessees, subtenantssub-tenants, sublessees, sub-lessees or vendees in of the premises herein conveyedSite. The foregoing covenants covenant of this Section 4.8 shall run be a covenant running with the land.‌land and binding on successive owners of all or any portion of the Site in perpetuity.
