Project Safety. 3.7.1 Design-Builder recognizes the importance of performing the Work in a safe manner so as to prevent damage, injury or loss to (i) any individuals at the Site, whether working or visiting, (ii) the Work, including materials and equipment incorporated into the Work or stored on-Site or off-Site, and (iii) any other property at the Site or adjacent thereto. Design-Builder assumes responsibility for implementing and monitoring all safety precautions and programs related to the performance of the Work. Design-Builder shall, prior to commencing construction, designate a representative (the “Safety Representative”) with the necessary qualifications and experience to supervise the implementation and monitoring of all safety precautions and programs related to the Work. Unless otherwise required by the Contract Documents, Design-Builder’s Safety Representative shall be an individual stationed at the Site who may have responsibilities on the Project in addition to safety. The Safety Representative shall make routine daily inspections of the Site and shall hold weekly safety meetings with Design-Builder’s personnel, Subcontractors and others as applicable. 3.7.2 Design-Builder and Subcontractors shall comply with all Legal Requirements relating to safety, as well as any Owner-specific safety requirements set forth in the Contract Documents; provided, that such Owner-specific requirements do not violate any applicable Legal Requirement. As promptly as practicable, Design-Builder will report in writing any safety-related injury, loss, damage or accident arising from the Work to Owner’s Representative and, to the extent mandated by Legal Requirements, to all government or quasi-government authorities having jurisdiction over safety-related matters involving the Project or the Work. 3.7.3 Design-Builder’s responsibility for safety under this Section 3.7 is not intended in any way to relieve Subcontractors of their own contractual and legal obligations and responsibility for (i) complying with all Legal Requirements, including those related to health and safety matters, and (ii) taking all necessary measures to implement and monitor all safety precautions and programs to guard against injury, losses, damages or accidents resulting from their performance of the Work.

Project Safety. 3.5.1 Vendor recognizes the importance of performing its Scope of Work in a safe manner so as to prevent damage, injury or loss to: (i) any individual at its, or its subcontractor’s, manufacturing facilities or the Site, whether working or visiting; (ii) the Plant, including materials, supplies and equipment provided by Vendor and incorporated into the Plant, or stored on-Site or off-Site; and (iii) any other property at the Site or adjacent thereto. Vendor * Confidential Treatment Requested assumes responsibility for implementing and monitoring all safety precautions and programs related to the performance of its Scope of Work and shall, when visiting or performing any services or activities at the Site, comply with Owner’s requirements as set forth in Exhibit I – Environment, Safety and Health Plan. Vendor shall submit its safety plan with respect to services it intends to perform at the Site to Owner for approval no later than thirty (30) days after the Effective Date. 3.5.2 Vendor and Vendor’s subcontractors and suppliers shall comply with all Legal Requirements relating to safety, as well as any Owner-specific safety requirements set forth in the Contract Documents. Vendor will report in writing any safety-related injury, loss, damage or accident arising from the performance of its Scope of Work at the Site to Owner’s Representative in accordance with Exhibit I – Environment, Safety and Health Plan and, to the extent mandated by Legal Requirements, to all Governmental Authorities having jurisdiction over safety-related matters involving its Scope of Work.

Project Safety. The Contractor shall be solely and completely responsible for safety conditions on the job site, including the safety of all persons and property during performance of the work to complete the Project. The services of District’s employees or the District’s agents or Consultant’s personnel in conducting review of the Contractor's performance is not intended to include review of the adequacy of the Contractor's work methods, equipment, or safety measures in, on or near the site. The Contractor shall provide safe access for the District and its inspectors to adequately inspect the quality of work and the conformance with project specifications. LEGAL CLAIMS AND ATTORNEY FEES: Each party hereto shall promptly report to the other any claim or suit against it arising out of or in connection with Contractor’s performance of the services. The District and Contractor shall each have the right to compromise and defend the same to the extent of its own interest; provided the defense of the same has not been tendered and accepted by the other party. In the event either party requires the services of an attorney in connection with enforcing the terms of this Contract or the breach of any covenant or condition of this Contract, the prevailing party will be entitled to reasonable attorneys’ fees, consultants’ fees, witness fees and other costs, both at trial and on appeal. NONDISCRIMINATION: In the hiring of employees for the performance of work under the Contract Documents the Contractor, its subcontractors, or any person acting on behalf of Contractor shall not, by reason of race, religion, color, sex, age, sexual orientation, national origin, or the presence of any sensory, mental, or physical disability, discriminate against any person who is qualified and available to perform the work to which the employment relates. WORK PERFORMED AT CONTACTOR’S RISK: Contractor shall take all precautions necessary and shall be responsible for the safety of its employees, agents, and subcontractors in the performance of the contract work. All work shall be done at Contractor’s own risk, and Contractor shall be responsible for any loss of or damage to materials, tools, or other articles used or held for use in connection with the work.
Project Safety. The following is a list of safety requirements for all Contractors that will be participating on this project. Please note the following: 18.2.1 The Contractor shall supervise and direct the Work, using the Contractor’s best skill and attention. The Contractor shall be solely responsible for, and have control over, construction means, methods, techniques, sequences, and procedures and for coordinating all portions of the Work under the Contract, unless the Contract Documents give other specific instructions concerning these matters. If the Contract Documents give specific instructions concerning construction means, methods, techniques, sequences or procedures, the Contractor shall evaluate the jobsite safety thereof and, except as stated below, shall be fully and solely responsible for the jobsite safety of such means, methods, techniques, sequences, or procedures.

Design-Build Subcontractor assumes responsibility for implementing and monitoring all safety precautions and programs related to the performance of the Work. 2.13.2 Design-Build Subcontractor and Sub-Subcontractors shall comply with all Legal Requirements relating to safety, as well as any Owner-specific and/or Design-Builder-specific safety requirements set forth in the Contract Documents or established for the Project, provided that such Owner-specific and/or Design-Builder-specific requirements do not violate any applicable Legal Requirement. Design-Build Subcontractor will immediately report in writing any safety-related injury, loss, damage or accident arising from the Work to Design-Builder’s Representative and, to the extent mandated by Legal Requirements, to all government or quasi-government authorities having jurisdiction over safety-related matters involving the Project or the Work.

Project Safety. The Contractor will be responsible for safety at the Project site and will follow all applicable safety and health regulations during the progress of the Project and will monitor all of its employees and its subcontractors for compliance with such safety and health regulations. In undertaking the responsibilities set forth in this Paragraph, the Contractor does not assume any duty or responsibility to the employees of any subcontractor or supplier, regardless of tier. The Owner assumes no responsibility for the development, review, or implementation of the any Project safety plan or for Project safety and has no authority to direct the means and methods of the Contractor.

CM@Risk understands and agrees that it shall be responsible for implementing and monitoring all safety precautions and programs related to the performance of the Work. CM@Risk also understands and agrees that it shall review the safety programs developed by each of the subcontractors and prepare and submit to the OPT its comprehensive safety program that complies with all Legal Requirements upon completion of the document outlining and describing the program. CM@Risk shall also ensure compliance by the Subcontractors of their contractual safety requirements. 2.11.3. CM@Risk understands and agrees that it shall, prior to commencing construction, designate a Safety Representative with the necessary qualifications and experience to supervise the implementation and monitoring of all safety precautions and programs related to the Work. Unless otherwise required by the Contract Documents, CM@Risk’s Safety Representative shall be an individual stationed at the Site who may have other responsibilities on the Project in addition to safety. 2.11.4. CM@Risk understands and agrees that the Safety Representative shall make routine daily inspections of the Site and shall hold weekly safety meetings with CM@Risk’s personnel, Subcontractors, and others as applicable. 2.11.5. CM@Risk understands and agrees that it and its Subcontractors shall comply with all Legal Requirements relating to safety, as well as any City-specific safety requirements set forth in the Contract Documents, provided that such City-specific requirements do not violate or conflict with any applicable Legal Requirement. In the event of any conflict or violation, the Legal Requirement shall supersede and control. 2.11.6. CM@Risk understands and agrees that CM@Risk shall immediately report in writing to the RPR any safety-related injury, loss, damage, or accident arising from the Work and, to the
Project Safety. 12.1 The CM shall develop and implement a site specific project safety program in accordance with the General Conditions For Construction and applicable regulations and provide a copy to the OWNER. 12.2 The CM shall report, to the OWNER, as part of each monthly report, any safety violations and actions taken to protect the safety of persons and property engaged in the work. 12.3 The CM shall coordinate with the Owner’s independent safety inspection program by facilitating inspections and providing information to the independent safety inspectors as requested.
